• <br />Responses to Specific Findings That CWCB Is Required To Make <br />1. The Silverthorne RICD will not impair the ability of Colorado to fully develop <br />and place to consumptive beneficial use its Compact entitlements. <br />a. The amount and location of remaining unappropriated Compact <br />Entitlements <br />There are remaining unappropriated Contact Entitlements in the Colorado River <br />Basin. There is little or no chance that these remaining Compact Entitlements <br />will be affected by the Silverthorne RICD because: <br />• The Silverthorne RICD, i.e., the Blue River Whitewater Course <br />(Course) will be located approximately 220 miles upstream from <br />the Colorado/Utah boarder. <br />• The Course has zero consumptive use and will not change the <br />timing of the flows. <br />b. Proximity of the RICD to the State Line <br />As shown in Exhibit C, the Course is located approximately 220 stream miles <br />from the Colorado/LJtah border and, consequently, there is no potential for the • <br />Course placing a priority call which would result in unused water flowing into <br />Utah. <br />c. Proximity of the RICD to suitable upstream points of diversion or storage <br />The Course is located in the headwaters of the Colorado River Basin and there is <br />only 3.6 percent of the total Colorado River Basin area (350 square miles out of <br />9,800 square miles) upstream from the Course. Consequently, there are relatively <br />few suitable upstream points of diversion or storage. <br />The Course will have no consumptive use. Therefore, the Course will not <br />diminish flows available for diversion by other water rights either upstream or <br />downstream on the Blue and Colorado Rivers. <br />d. Existence of suitable downstream points of diversion or storage <br />Because the Course will have no consumptive use and will not affect the timing of <br />stream flows, the Course will have no affect on suitable downstream points of <br />diversion or storage. <br />•
