2. Summit County, the River District, and other entities, including <br />Silverthorne, are actively involved in projects intended to provide adequate water <br />supplies to satisfy the projected increased future demands in Summit County. Such <br />projects may involve future upstream appropriations, and changes, transfers, or <br />exchanges of water from points downstream to points upstream of the RICD. These <br />projects include, but are not limited to the following: <br />a. Old Dillon Reservoir. Summit County owns an interest in the <br />conditional water rights decreed for the enlargement of Old Dillon Reservoir. As <br />described more fully in the River District's Prehearing Statement, Summit County and <br />the River District are presently studying alternatives to improve the utility of Old Dillon <br />Reservoir and maximize its use. Such alternatives may involve use of the existing rights <br />as presently decreed, and/or necessitate changes of the existing rights or additional <br />appropriations. Summit County seeks to ensure that the Silverthorne RICD will not <br />impair or adversely affect implementation of the potential alternatives determined by the <br />study. <br />b. Blue River Pumpback. The "Everist Puxnpback ProjecY" is <br />described in Exhibit C(pages 27-33) of the River District's Prehearing Statement. The <br />pumpback could allow for storage of additional inflows to Dillon Reservoir, which could <br />then be used, in part, as a source of augmentation for Summit County water users above <br />Dillon Reservoir. Summit County seeks to ensure that the Silverthorne RICD will not <br />serve as a basis for opposition to any possible future efforts to implement the pumpback <br />proj ect. c. Upper Blue Reservoir MOA. Summit County is a party to the May <br />15, 2003 Memorandum of Agreement with Colorado Springs Utilities, which is attached <br />as Exhibit D to the River District's Prehearing Statement. Summit County seeks to <br />ensure that the Silverthorne RICD will not be a barrier to the use, reuse, or any related <br />exchanges of the Upper Blue Reservoir Water stored pursuant to the MOA for the benefit <br />of the "West Slope Account." <br />d. Reservoir Contracts. Pursuant to a series of contracts with the <br />Middle Park Water Conservancy District (copies attached as Exhibits "Summit 1" <br />through "Summit 5"), Summit County has contractual rights for the use of up to 390 acre- <br />feet of water annually from Granby and Wolford Mountain Reservoirs. Summit County <br />utilizes the water supplied under these contracts for a number of purposes, including as a <br />replacement water source under the County's augmentation plan decreed in Case No. <br />95CW122, District Court, Water Division No. 5. The Decree in Case No. 95CW122 also <br />allows Summit County to utilize water from Green Mountain Reservoir as a replacement <br />source, pursuant to a valid contract. While such uses are senior to the rights claimed for <br />the Silverthorne RICD, any surplus water pursuant to such contracts could be used as a <br />replacement source for future exchanges or augmentation plans above the Silverthorne <br />RICD. Summit County seeks to ensure that the Silverthorne RICD will not impair the <br />2
