Consolidated Civil Case <br />Nos. 2782, 5016 and 5017 and <br />Case No. 91CW252, WD 5 <br />construction and will be owned and operated by the River <br />Discrict. woif'??=d Mountain Reservoir will store water behind <br />a dam located acrcss the channel of Muddy Creek in Section 25, <br />Township 2 Norz--, Range 81 West of the 6th P.M. in Grand <br />County, Coloradc. The'right to store the waters of Muddy Creek <br />under an apprcpr_ation dated December 14, 1987, is evidenced by <br />Decree of the District Couzt for Water Division No. 5 in its <br />Case No. 87CW283 -dated November 20, 1989. <br />10. Under the E?t-ipulation in these Consolidated Cases dated <br />October 5, 1955, the Eoard is permitted to withhold Blue River water <br />in its upstream junicr Dillon Reservoir which might la-ter be found <br />by the Secretary to be required to complete the fill of the senior <br />downstream Green NounLain Reservoir because that reservoir had not <br />filled from the tributary inflow'ta the Blue River below Dillon <br />Reservoir. In such a•,iear, under procedures provided for in the MOA <br />and this Decree and _n compliance with paragraph 2 of the April 16, <br />1964 Consent Decree _: these Consolidat.ed Cases, the Secretary may <br />accept a substitute supply of water for such withheld water instead <br />of requiring the Bcarc to release water withheld in Dillon Reservoir <br />during that year =o complete the fill of the more senior Green <br />Mountain Reservoir. <br />12.
