Consolidated Civil Case
Nos. 2782, 5016 and 5017 and
Case Na. 91CW252, WD 5
subst_tution ror =?e amount of water r_he Secretary would otherwise
require the Boaru ~o release from Dillon Reservoir to complete the
annual Fill of Green Mountain Reservoir. The Secretary will, to the
extent such water T:ay be required to meet the fill requirements of
Green Mountain Reservoir, credit water retained by the Board in
Dil'Lon Reservoir ?o the fill of Green Mountain Reservoir. The water
retained by =he ?oard in Dillon Reservoir will be used for all
purwoses for whic^ sucn reservoir has been decreed and such uses are
sub?ect to the li:??itations as are set forth in the October 12, 1955
Decree in these Consolidated Cases.
12. The Secretary agreed to procedures for the use of water
stored in the Board's account in Wolford Mountain Reservoir in
substitution for water otherwise required to be released by the
Board from DiZlon Reservoir under the terms and conditions set forth
in the attached MOA.
13. The f'Lcw of the Blue River downstream of Dillon Dam and
the Llow of Muddy Creek downstream of Wolford Mountain Reservoir may
be affected. by the substitution. A hydrologic analysis of the
stream systems _nvolved demonstrates that in those years when a
subsr.itution is made, the flow of the Blue River and Muddy Creek
dur_zg the reservczr storage season will be no different from the
flow that would cccur in the same season of a year in which no
subsequent subst?-_ution would be made_
10
