Consolidated Civil Case <br />Nos. 2782, 7.016 and 5017 and <br />Case No. 91CW252, WD 5 <br />July 1 through ":ovember 1 without impacting the Board's yield <br />from Wolford Mou ::.ain Reservoir and snall use a process similar <br />to that set for:h for substitutions which is described in <br />subparagraph 19.2 hereof. <br />25.3 If the Secretary approves, the River District, at <br />the Board's request, wi11 release the Board's stored waCer from <br />its wolford Mou:tain Reservoir account for delivery to Che <br />Colorado River ?n exchange for water from the Blue River to be <br />stored in the Dillon Reservoir or diverted through the <br />Montezuma Tunnel for use for the purposes set forth in the <br />Decrees to those s'-ructures. <br />26. This Decree is administrable by the Division Engineer for <br />water Division No. 5 and can be operated without adversely affecting <br />the owners or users cf vested water rights or decreed conditional <br />water rights on the B'ue River and Muddy Creek or their tributaries <br />or on the Colorado =iver. So long as releases as are required <br />herein are made and cperations of this plan for augmentation- <br />substitucion are in conformance with the reauirements of this <br />Decree, the underlyina stipulations and the conditions of the MOA, <br />there wi11 be no i~jurious effects to the vested or decreed <br />conditianal water riuhts of others related to the amount or timing <br />of water availability. Subject t:o retained jurisdiction as provided <br />in paragraph 37 belcw, Opposers Grand Juncticn and Clifton have <br />agreed not to claim _njurious effects to their vested or decreed <br />28
