Consolidated Civil Case <br />Nos. 2782, 5016 and 5017 and <br />Case No. 91CW252, WD 5 <br />conditional water rights based on water quality. Opposers Palisade <br />Irrigation District and Orchard Mesa Irrigation District have <br />stipulated to a settlement with the Co-Applicants. No other Opppsex <br />has claimed injurious effects to their water rights based on water <br />quality. The State Enginser in arder to prevent injury to vested <br />water rights shall, pursuant to Section 37-92-305(8), 15 C.R.S. <br />(1990) , curtail out of priority diversions which are not replaced to <br />the stream system pursuant to this Decree. <br />27. Except as expressly set forth herein, entry of this Decree <br />does not modify, alter or amend the rights and obligations of the <br />parties established under prior stipulations and decrees in these <br />Consolidated Cases which govern the operation of Green Mountain <br />Reservoir. <br />CONCLUSIONS OF LAW <br />The Court concludes as a matter of law that: <br />28. The Federal District Court's retained jurisdiction was <br />properly invoked in these proceedings to resolve matters involving <br />procedures which effectuate the objectives of its Judgment and <br />Decree of October 12, 1955, and the Consent Decree of ApriZ 15, <br />1964. <br />29. The proposed plan for augmentation-substitution and the <br />proposed exchanges are authorized by iaw and can be implemented <br />under the terms and ccnditions set forth in the MOA and this Decree <br />29
