? • Absolute and conditional water rights, including rights of exchange, senior to the <br />December 31, 2004 date of appropriation for the Silverthorne RICD will not be <br />affected by the Silverthorne RICD. <br />• Absolute and conditional water rights and future water rights applications which <br />have priority dates junior to December 31, 2004 will be administered by the State <br />Engineer in accordance with Colorado Law and the normal practices and <br />procedures of the Colorado State Engineer. <br />? The CWCB's November 8, 2001 Recreational In-Channel Diversion Rules and <br />Colorado Water Law do not require subordination of RICD water rights to junior <br />water rights decreed for other uses. <br />• The flow triggers for priority calls from the Silverthorne RICD will assist in <br />promoting maxirnum utilization by decreasing the frequency and amount of <br />priority calls from the Silverthorne RICD water right. <br />• Exhibit S indicates an annual average of approximately 110,600 acre-feet of flow <br />availability for exchanges through the Silverthorne RICD reach of the Blue River. <br />This flow volume will provide exchange capacity future exchanges with priorities <br />junior to December 31, 2004. <br />? • The Silverthorne RICD will promote maximum utilization because it is a non- <br />consumptive use and can utilize all flows physically available to this water right. <br />The Silverthorne RICD is equivalent to a fully augmented junior water right. <br />Therefore, it will increase utilization of waters of the State. <br />40 <br />4
