0 3.0 SPECIFIC RESPONSES <br />3.1 SUMMIT COUNTY <br />The Silverthorne RICD will not prohibit Summit County from meeting its future water <br />demands in the Colorado River Basin above the RICD as addressed in the UPCO report <br />for the following reasons: <br />• As discussed in Section 2.4, the ability of water users in the Colorado River <br />Basin, including Summit County to maximize use of their decreed absolute and <br />conditional water rights will not be affected by the Silverthorne RICD. <br />• Summit County's absolute and conditional water rights, including exchanges, <br />with priorities senior to 2004 will not be affected by the non-consumptive <br />Silverthorne RICD. Administration by the Division 5 Engineer in accordance <br />with Colorado Water Law will protect these existing senior rights. <br />• The RICD will only operate during the daylight hours (7 am to 8 pm) and for the <br />summer months May to September. Therefore, Summit County's decreed water <br />rights, including exchanges, and future water rights and exchanges with priorities <br />junior to 2004 will be able to divert andlor exchange unaffected by the <br />Silverthorne RICD during the months of October through April and during the <br />? night (8 pm. To 7 am) throughout the year. <br />As shown in Exhibit S and discussed in Section 2.3, based on the study period of <br />1960-2004, an annual average of approximately 110,600 acre-feet of flow is <br />available for exchange through the Silverthorne RICD reach with the <br />Silverthorne RICD operating. This available flow volume for exchange should <br />mitigate the effects of the Silverthorne RICD on existing and planned Summit <br />County exchanges with priorities junior to 2004. <br />• The proposed flow triggers regulating when Silverthorne can place a priority call <br />for its RICD will further protect any future exchanges proposed by the County. <br />Summit County is involved in the following projects to meet future water demands and <br />expressed concern about the effect of the Silverthorne RICD on these projects: <br />• Old Dillon Reservoir: Summit County has water rights decreed for 46.14 acre- <br />feet for Old Dillon Reservoir and 150 acre-ft for Old Dillon Reservoir <br />Enlargement that are senior to the RICD and therefore will not be affected by the <br />RICD. <br />• Blue River Pumpback: No water rights applications have been filed and this <br />project has not yet been designed. The Blue River Pumpback will pump back <br />? flows diverted at the Everist Gravel Pits downstream from the Silverthorne RICD
