submitted to the PRRIP Gavernance Committee in Ociobcr of each year. Thc
Operating Commiucc witl annually dcvclop a draft of this plan for
consideraticm and approval by DNR and SPWRAP prior to August 1 of each
ycar.
c. F'inancial Obliga?ions to YCZIZIP
Colorado's cash obligatian to PRRIP is anticipatcd to be approximatcly
$24,000,000 in ?QOS doilars ovcr the cantcmplatcd thirtccn ycars of the First
(ncremcnt. In addition, C'olorado lias obligations under the PruLyram to ra
regulate river flows at the state line which tivill cntail additional costs. If the
First Incremcnt is crtcnded, it is probable ihat Colorado will have additianal
raonctary obligations, howcvcr, thc amount of such obligations cannot yct bc
cstimatcd.
ii The Operating Comntittce will dcvelop a budget that will identify, to the
extent possiblc, all af the costs involved in meeting Goloracio's PRRIP
obligatiuns, the timc-fi-amc within which each of those obligations wilt be
met, ancj the minimtun fiinding rcyuirrrncnt for cach ycar of the PRItIP. A
prcliminary estimatc of the total cost of mceting all PltR1P obligations is
attached hereto as Exhibit A. This estiiiiatc will bc furlher developed and
retined by the Operating Committee.
iii '1'he Partics acknowlcdbe that financial obligations of Colorado payabte after
the curreiit tiscal year are contingent upon Cunds for that purpwse being
appropriated, hudgcted, and otherwise nlade available. Because Colorado
dacs not havc availablc at tliis time the entirc amount of n}oiiey needed ta
meet PRRIP obligations, and because fiuidiiiu for the PK[2II' in the future
remains uncertain, SPWIt11P anci llhrit ezgrec that I?NR will seek funding
through the Icgislativc process iu cach ycar ftirther appropriations are
necessary, aud where practical to do so, SPWRAP and its membcrs witl
support llNR's cfforts through legislative contacts. A timc-line describing the
state budget process ancl relevant deacilines is attached herato as Exhibit B.
Cach ycar the Opcrating C'ornmittcc will updatc its cstimatc a('the miilimum
liuiding requircmcnt based an the circumstances at the time. Each year the
Partics will agree upon the amount of funding to be reyucsted from the
legislaturc, which amount could be grcatcr or less than the minimum funding
reyuircment for that year.
iv in the evcnt suf'ficient fimds are not made available by the l..egislature to meet
the minimum funding rcyuircmcnt in a givcn ycar, DNR will notify SPWRAP
in writing as to the amount of the shortfall, and SI'W}tAP agrccs to usc: its
best effarts to pay such shortfa(ls. SPWRAP contemplates raising this money
through fee assessmcn(s paid by its mcmbcrs. Thc amount of moncy kcpt in
reserve by SPWRAP for mccting shortfalls will bc dctcrmincd by SPWRAP
in ics discretio?z after consu(tation with DNR. In the event it becomes
4 SPWRAP-I)NR MoA I 1-V4-136
