In addition, C'olorado lias obligations under the PruLyram to ra <br />regulate river flows at the state line which tivill cntail additional costs. If the <br />First Incremcnt is crtcnded, it is probable ihat Colorado will have additianal <br />raonctary obligations, howcvcr, thc amount of such obligations cannot yct bc <br />cstimatcd. <br />ii The Operating Comntittce will dcvelop a budget that will identify, to the <br />extent possiblc, all af the costs involved in meeting Goloracio's PRRIP <br />obligatiuns, the timc-fi-amc within which each of those obligations wilt be <br />met, ancj the minimtun fiinding rcyuirrrncnt for cach ycar of the PRItIP. A <br />prcliminary estimatc of the total cost of mceting all PltR1P obligations is <br />attached hereto as Exhibit A. This estiiiiatc will bc furlher developed and <br />retined by the Operating Committee. <br />iii '1'he Partics acknowlcdbe that financial obligations of Colorado payabte after <br />the curreiit tiscal year are contingent upon Cunds for that purpwse being <br />appropriated, hudgcted, and otherwise nlade available. A timc-line describing the <br />state budget process ancl relevant deacilines is attached herato as Exhibit B. <br />Cach ycar the Opcrating C'ornmittcc will updatc its cstimatc a('the miilimum <br />liuiding requircmcnt based an the circumstances at the time. Each year the <br />Partics will agree upon the amount of funding to be reyucsted from the <br />legislaturc, which amount could be grcatcr or less than the minimum funding <br />reyuircment for that year. <br />iv in the evcnt suf'ficient fimds are not made available by the l..egislature to meet <br />the minimum funding rcyuircmcnt in a givcn ycar, DNR will notify SPWRAP <br />in writing as to the amount of the shortfall, and SI'W}tAP agrccs to usc: its <br />best effarts to pay such shortfa(ls. SPWRAP contemplates raising this money <br />through fee assessmcn(s paid by its mcmbcrs.
