The Operating Committcc rnay choosc ta crcatc <br />subcommittees to rocus on certain subject areas if it determines that doing so <br />is advisabte. <br />ii It is anticipated that on most issues the Operating Committce wili be able to <br />re.ach a consensus, and such determinations wili be ratificd by UNR and <br />SPWKA}'. In the event the Opcrating Committee is tinable to reach a <br />conscnsus, appropriate members of the Operating Committee witl present the <br />compctiiig svlutions or detcrnlinations to the Dircctor of the I:)NR and tllc. <br />SI'V4'RAP board. Water Obiigatians Associated With The Colorado Prpgram. The proposed <br />program to re-time or re-regulate tlows in the lawcr South Ylattc River is an <br />important element of the PRRIP within Colorado. The Parties wiil a3ree upon a <br />plan far meeting Calorada's re-regulation obligations (thc "Water Projects Plan" <br />fornierly known as the "Tamar,ack Plan") based on recommendations of the <br />Uperatiilg Committec. The Parties acknowlcdge that the Water Projects Plan may <br />evolvc ovcr the course of the First lncrement, ncvertheless, the Parties will scck to <br />have an initial Water Projects Plan in ptacc by January 1, 2008. The Opc;raiing <br />Committec will also develop an appropriate mcans of documeneing the Partics <br />agreement on the initial Water Projccts Plan, including amcndments thcrcto. <br />Furthcr agreements betwcen UVR or sub-agcncics within DNR, SYWRAI' and <br />perhaps third parties may be entcrcd to implernent the Water Projects Plan. <br />One such anticipated further agcement invotves the Colorado DivisiUn of <br />Wildlifc ("CUOW") penaining to the use of thc 'famarack Raiich State <br />Wilcilife Area and the Pany Express State Wildlife Arca, along with certain <br />wells and related recharge facilitics located thereon. SPWRAP and DNR <br />acknowtedge that use of these facilities for PRRIP purposcs cannot viofate the <br />reyuircmcnts of the Pittman-Robcrtson Wildlife Kestoration Act by intcrfcring <br />with the primary use and managcment of the propcrtics for the wildlifc <br />purposcs by the CDOW. 1 <br />ii An amiual operatiiig plan describing aU of Colorado's re-regulatiem activities <br />and demonstrating compliance with Colorado's PRRIP obligations must be <br />''1'hesr SWAs ti-ere acquired, in part, widi fiinds provided through the Pittmau-Robcrtson Wildlifc <br />Restoratiun Act and pursuant to C.R.S. 33-I-117, the Statc of Colorado assented to managr the SWAs in <br />aecurdancr with said Act and the rules and regulations promulgated by the Secretary of the U.S. <br />t)cpartmcnt uf lutcrior ("USt)UC'). <br />SPWRAP-DNR MuA I I-14-UG
