Director Lingreen seconded the motion which passed unanimouslx <br />' Jiilesbzirg Recharge Demonstration Project: <br />In light of recent changes on the Julesburg Irrigation District Board, Manager Schott was directed <br />by the LSPWCD Board to once again try and discuss some kind of settlement with the Julesburg <br />Irrigation District regarding the Peterson Ditch Agreement. <br />WATER CONSERVATI0N BUSINESS: None <br />LEGAL REPORT: <br />Included in Counsel Lawrence's report were the following: <br />• Opposition to Vandemoer, 97-CW-211 - Water Court granted the Summary <br />Judgment Motion made by Counsel Lawrence, finding that Vandemoer was <br />Speculating on use by 86 wells. Vandemoer has filed a Motion to Reconsider. <br />Counsel Lawrence will file a response. <br />• Groves Farms Application, 99-CW-151 - Groves Farms does operate a feedlot of <br />400 head which was there before they bought the farm. They will leave Well #2 as <br />a commercial well. <br />• Resolution of the Board of Directors of the Lower South Platte Water Conservancy <br />District Water Activaty Enterpris., Concerning Payment of Assessments arad <br />i'ermination of Contracts - Counsel Lawrence reviewed the proposed Resolution <br />with the Board. The Directors requested the Resolution be amended in <br />Section #1 Payment of Contract Assessments beginning with the second sentence <br />to read as follows. "Allottees who fail to pay assessments by March lg` of any year <br />sha11 be sent a second written notice of assessment with a$75.00 late fee due and <br />payable April ls` of that same year. Allottees who fail to pay assessments and late fee <br />by April l` of any year shall be sent notice by registered or certified mail, return <br />receipt requested, at the address provided on the contract, or such other address <br />provided to the District, advising them that their water allotment contract will be <br />terminated on May lg` of that year and that their well or wells will be dropped from <br />the substitute supply plan." Director Bolinger made the motion to adopt the amended <br />Resolution. Director LinUeen seconded. Motion was unanimously approved. <br />4
