WHEREAS, the parties are in the process of determining how they wiil seek a Financial
<br />Management Entity for implementing the Program, and that process may take up to a year to
<br />complete.
<br />NOW THEREFORE, it is hereby agreed that
<br />1. Consideration for this amendrnent #5 to the original contract, (PDA 00-00002 Contract
<br />Routing Number), (Contract Encumbrance Number, C153878), dated July 1, 1999,
<br />Amendment #1, dated October 27,1999, Contract Routing # Ol PDA 00024, Amendment
<br />#2, dated December 4, 2003, Contract Routing #04 PDA 00035, Amendmeat #3, dated May
<br />12, 2004, Contract Routing #04 PDA 00075, Amendment #4, dated March 31, 2006,
<br />Contract Routing #06 PDA 00073 consists of the payments which shall be made pursuant to
<br />this amendment and the promises and agreements herein set forth.
<br />2. It is expressly agreed by the parties that this amendment #5 is supplemental to the original
<br />Contract Routing Number 00 PDA 00002 contract #C153878 dated July 1, 1999, as amended
<br />October 27, 1999, Contract Routing Number Ol PDA 00024, as amended on December 4,
<br />2003 Contract Routing Number 04 PDA 00035, as amended on May 12, 2004, Contract
<br />Routing Number 04 PDA 00075, and as amended March 31, 2006 Contract Routing No. 06
<br />PDA 00073, collectively refened.to as the "ori,ginal contract," which is, by this reference,
<br />incorporated, and made a part hereof, and all terms, conditions, and provisions thereof, unless
<br />specifically modified herein; are to apply to this amendment as though they were expressly
<br />rewritten, incorporated, and included herein.
<br />3. It is agreed the original contract is and shall be modified, altered, and changed in the
<br />following respects only:
<br />4. The following changes are made to the paragraphs of the original agreements as cited below:
<br />a. Section A. Purpose and Background:
<br />A.1. PROJECT TITLE: Substitute the following for the existing language:
<br />"Administrative Support to the Governance Committee and Executive Director
<br />Established Pursuant to -the July 1997 Cooperative Agreement for Platte River Research
<br />and Other Efforts (Including the 2006 Program Agreement) Relating to Endangered
<br />Species Habitats Along the Central Platte River, Nebraska (references to this effart shall
<br />be described as the `July 1997 Agreement')."
<br />b. Add: A.2.d.: The Platte River Implementation Governance Committee, Interim Executive
<br />Director, and other committees require administrative support in order to accomplish the
<br />purpose of the December 2006 Program Agreement, scheduled to begin January 1, 2007.
