Monitoring and Reporting requirements: <br />The Bureau will ensure that Ute Water does not deplete more than <br />the Phase 1 and Phase 2 amounts of water from the 15-mile reach. <br />The Bureau will require Ute Water to accurately measure and <br />record total water usage (inflow to or outflow from its water <br />treatment plant). The Bureau will submit a report to the <br />Service annually which presents the Project's new depletions, <br />calculated as make-up flows, for each of the 10 previous years <br />and the average for these years. <br />5. Depletion fee: <br />The Project's new depletions will be measured against the sufficient <br />progress threshold using the Project's reduction of flows below the <br />Service's recommended flows in the 15-mile reach (make-up flows); <br />this is because the Project's greatest depletion impacts occur within <br />the 15-mile reach and a reasonable and prudent alternative must <br />offset all impacts which cause jeopardy to the species or destruction <br />or adverse modification of critical habitat. However, the depletion <br />fee will be calculated using the new depletion to the basin measured <br />below the Persigo Waste Water Treatment Plant; this is because the <br />depletion fee structure was based on the total depletion to the basin <br />projected to occur after inception of the Recovery Program and on the <br />portion of the cost for recovery to be paid by water users.
