Phase 2: <br />w depletions (not to exceed an <br />1,500 acre-feet) will be authorized <br />without reconsultation. <br />If and when the sufficient progress threshold is raised, the <br />Service will amend this biological opinion to identify the <br />Recovery Program as the reasonable and prudent alternative for <br />an amount of the Project's new depletion equivalent to the new <br />sufficient progress threshold (the Phase 1 depletion cannot <br />exceed 1,500 acre-feet until this biological opinion is amended <br />to reflect an increase in the sufficient progress threshold}. <br />As described in "1." above, for the purpose of comparison with <br />the new sufficient progress threshold, the new depletion would <br />be measured as an average of the past most recent 10 annual <br />make-up flows. In its April 5, 1996, sufficient progress <br />review, the Service stated that the sufficient progress <br />threshold would be raised to 3,000 acre-feet provided five <br />actions are completed and assuming sufficient progress in other <br />Recovery Program areas is maintained. According to the <br />hydrological analysis, the Project will cause an average annual <br />new depletion of 3,003 acre-feet, calculated as make-up flows, <br />in the year 2015. Phase 2 depletions will meet projected <br />demands until the year 2015; however, if subsequent phases are <br />not implemented, Phase 2 new depletions (not to exceed an annual <br />average depletion of 3,000 acre-feet) will be authorized for the <br />life of the Project without reconsultation. <br />3. Calculation of new depletion: <br />In calculating the Project's new depletion as an average of the <br />past most recent ten annual make-up flows, a hydrological <br />analysis must be performed for each year as was performed for <br />each year of the 1975 to 1993 period of record and presented in <br />the biological assessment. In performing these annual <br />hydrological analyses, the Project's flow reductions must be <br />measured against the section 7 baseline conditions established <br />for-the Project in 1996; adjusted over time by the potential <br />conversion of the consumptive portion of historic agricultural <br />water rights. Actual flows in years since the end of the period _ <br />of record will include the depletion effects of projects which ,~~ <br />are not included in the section 7 baseline for the Project. ~~) <br />Also, actual flows in years since the end of the period of `''~~, <br />record will include the effects of endangered fish recovery <br />r actions (reservoir reoperations, canal efficiency improvements, <br />etc.) which are not included in the section 7 baseline for the <br />Project. The hydrological analysis for years after the end of <br />the period of record will be adjusted to remove the effects of <br />those new projects and endangered fish recovery actions which <br />r .~ `'~~ <br />
