All payments should be made to the <br />Foundation. <br />National Fish and <br />1120 Connecticut <br />Suite 900 <br />Washington, D.C. <br />Wildlife Foundation <br />Avenue, N.W. <br />20036 <br />In a letter dated , <br />agreed to this payment (Appendix A). <br />Each payment is to be accompanied by a cover letter that <br />identifies the project and biological opinion that requires <br />the payment, the amount of payment enclosed, check number, <br />and any special conditions identified in the biological <br />opinion relative to disbursement or use of the funds (there <br />are none in this instance). The cover letter also shall <br />identify the name and address of the payor, the name and <br />address of the Federal Agency responsible for authorizing <br />the project, and the address of the Service office issuing <br />the biological opinion. This information will be used by <br />the Foundation to notify the payor, the lead Federal Agency, <br />and the Service that payment has been received. The <br />Foundation is to send notices of receipt to these entities <br />within 5 working days of its receipt of payment. <br />B. New Depletions Above Sufficient Progress Threshold (Phase 3): <br />1. Phase 3: <br />The Recovery Program's Management Committee is currently <br />developing a strategy for addressing depletions (historic and <br />new) to the 15-mile reach that will contribute to the recovery <br />of the endangered fishes in the Upper Colorado River Basin. The <br />Service has determined that development of a reasonable and <br />prudent alternative for the Project's new depletions which <br />exceed the sufficient progress threshold should follow <br />v completion of this 15-mile reach strategy. Therefore, with <br />~.u~-~ concu from BLM and the a licant, the Service eci a to <br />~ v~ evelop a reasonable an pru ent a ernative now for <br />construction of the pipeline, historic depletions, and new <br />depletions up to the sufficient progress threshold and to <br />post one consultation on new depletions which exceed the <br />su• icient progress threshold. <br />The BLM should initiate consultation on the Project's new <br />depletions which exceed the sufficient progress threshold after <br />the Recovery Program completes its development of the 15-mile <br />reach strategy and be-fore the Project's new depletions are <br />projected to exceed the sufficient progress threshold. <br />
