Recommendations made by the Fish and Wildlife Service, as in the Conserva- <br />tion Plan are based on historic flows of the Colorado River System and <br />the biological life history requirements determined in field investiga- <br />tions reported on last year. The recommendations made by the FWS for <br />the endangered fishes of the Green and Colorado rivers are being <br />monitored through Reclamation's 3-year Colorado Fishery Monitoring <br />Program. Field Studies on the fishes are continuing to meet with much <br />success.. Radio-telemetry work with the squawfish has proven to be <br />successful in identifying potential spawning areas and other important <br />habitats. This information will contiunue to assist in developing an <br />overall management plan for the fish. <br />IV. Significant Legal Action <br />A. Fish - Wildlife <br />The Colorado River Water Conservation District et al. versus <br />The Secretary of the Interior et al. concerns the improper listing <br />of the Colorado Squawfish and Humpback Chub. The judgment by the <br />U.S. District Court (Colorado) on August 13, 1981, that the two <br />endangered fishes were improperly listed was withdrawn and the new <br />decision states: <br />1. The Squawfish and Humpback Chub are properly listed. <br />2. The ESA applies to completed projects which have an <br />ongoing adverse-effect on listed species. <br />3. Critical habitat must be determined for the totoaba <br />which only inhabits Mexican waters. <br />4. The plaintiffs will have to petition the Secretary if, <br />they disagree with the scientific basis for the squawfish and chub <br />listings as endangered. <br />t 10
