The court left unresolved the issues relating to the <br />effects of the operation of the existing dams and stocking non-native <br />fish species on the squawfish and humpback chub, the legality of the <br />recovery plans, and if the Department is impeding the plaintiffs' projects. <br />6. A stipulation of Settlement has been drawn up which if <br />approved would require Interior to enter informal discussions with the two <br />conservancy districts concerning biological needs of any Federally listed <br />species within the project impact areas. Basically, the stipulation provides <br />agreement that the districts and Interior will cooperate and coordinate <br />information at the draft stage on projects which the two districts have an <br />interest in, that Interior will provide notice before any endangered fishes <br />are introduced into district project areas. <br />B. Jones Hole Suit <br />The State of New Mexico has sued the Secretary of the Interior <br />not to close or transfer to Utah the Jones Hole National Fish Hatchery <br />because it would violate Federal law. Those laws violated include the CRSP <br />Act, the Fish and Wildlife Coordination Act and NEPA. New Mexico's goal. is <br />to prevent any Federal action that would result in less fish available for <br />stocking in Navajo and Heron Reservoirs in New Mexico. <br />11
