4 <br />NEPA Section 102(2)(C) requires a "detailed statement" at the time of a <br />"recommendation or report" on a "proposal" for action. The detailed statement is <br />known as the Environmental Impact Statement. <br />NEPA Section 202 creates the Council on Environmental Quality. The CEQ, created <br />by statute, cannot be abolished without subsequent legislation. Throughout its <br />existence, CEQ has been supported by the administration at varying levels of <br />activity. <br />Brief History of NEPA Legislation <br />- Early legislation. In 1959, Senator Murray introduced a bill declaring a <br />national policy and council of advisors to the President. <br />- In 1960's, public concern about pollution and environmental effects was <br />heightened by Rachel Carson's Silent Spring and by conservation groups. <br />- Two events, in particular, pushed Congress toward NEPA legislation. <br />-- Tanker Torry Canyon disastrous spill (1 19,000 tons of crude oil) in <br />March 1967, in England with no planned/adequate techniques for <br />clean-up. Extensive media coverage and strong public reaction. <br />-- In January 1969, disastrous blow-out of millions of gallons of oil from <br />off-shore rig in Santa Barbara Channel, California. Untold numbers of <br />waterfowl and aquatic life killed. Extensive media coverage. Much <br />public criticism. Interior Secretary Hickle ordered the drilling to cease. <br />- In mid-1969, both Senators Muskie and Jackson had competing bills on <br />protecting environmental quality. After negotiations, a compromise was <br />reached and an amended Jackson bill moved forward. <br />- In mid-December 1969, Senator Jackson and Congressman Dingell agreed to <br />the conference report. <br />- January 1, 1970: <br />-- Legislation signed by President Nixon. (Public law 91-190, 42 U.S.C. <br />4321-4347} <br />- Several amendments to 1970 law in 1975.. <br />- Other Legislation affecting NEPA: <br />-- Environmental Quality Improvement Act of 1970 (Public Law 91-224, <br />April 3, 1970). Clarified duties of Office of Environmental Quality <br />(OEC) and annual report. <br />
