"Articles of Incorporation" shall mean and refer to the Articles of Incorporation for the <br />Kenosha Trout Club, as they may be amended from time to time. <br />"Club" shall mean and refer to the Kenosha Trout Club, or its successors and assigns. <br />"Bylaws" shall mean and refer to the Bylaws of the Kenosha Trout Club, as they may be <br />amended from time to time. <br />"Common Areas" shall mean and refer to all real and personal property, if any, owned or <br />maintained by the Club for the common use and enjoyment of the Owners, or leased, controlled or <br />otherwise acquired by the Club for the benefit of the Owners, except platted Lots which shail not be <br />Common Area. <br />"Dues" shall be the expenses allocated to each Lot pursuant to a budget of cash requirements <br />as determined by the Board and approved by the Voting Members and shall also include late charges, <br />attorneys' fees, fines, interest and other assessments charged by the Club. The Dues of the Club <br />shall be mandatory. - <br />"Community" shall mean the Real Estate subject to this Declaration and the Owners of the <br />Lots bound by this Declaration. <br />"Declaration"shall mean this Amended and Restated Declaration of Covenants, Conditions <br />and Restrictions for the Kenosha Trout Club, as amended from time to time. <br />"Governing Documents"shall mean the Articles of Incorporation, the Bylaws, the <br />Declaratiori, and rules and regulations, including the caretakers manual, of the Kenosha Trout Club, <br />as amended. <br />"Improvement(s)" shall mean any building, fence, wall or other structure; any exterior <br />addition to, or change or alteration to, any building, fence, wall or other structure; any landscaping <br />that would alter the natural flow of water. <br />"Lot" shall mean and refer to any plot of land shown upon any recorded subdivision map of <br />the Real Estate with the exception of any Common Areas. <br />"Membership Fee" shall mean and refer to a charge paid by the purchaser upon application <br />for membership, the amount and payment of which shall be determined by the Board of Directors. <br />A Membership Fee shall be required for each Lot acquired within the Club, subject certain <br />exemptions provided in the Bylaws. <br />"Non-Voting Members" shall mean and refer to all Owners of a Lot who have not been <br />designated as the Voting Member for the Lot. <br />"Owner" shall mean and refer to the record owner, whether one or more persons or entities, <br />of the fee simple title to any Lot which is a part of the Property, but excluding those having such <br />interest merely as security for the performance of an obligation.
