AMENDED AND RESTA TED DECLARATION OF CO i�ENANTS, CONDITIONS, AND RESTRICTIONS FOR THE KENOSHA TROUT CLUB THIS AIVIENDED AND RESTATED DECLARATION is made on the date hereinafter set forth by The Kenosha Trout Club, a Colorado nonprofit corporation (the "Club"). RECITALS 1. The owners of lots within the Lininger Lake Subdivision located in Park County, Colorado more particulaxIy described as: All lots set forth in the amended 1VIap of Lininger Lake, a Subdivision of NW 1/4 of Section 16 and S1/2 SW1/4 of Section 9, Township 7 South, Range 75 West of the 6`'' P.M., as filed in the office of the Clerk and Recorder for Park County, Colorado on August 7, 1941 ("Real Estate") are subject to the Declaration and Establishment of Conditions, Reservations, Restrictions and Privileges for Lininger Lake, Park County, State of Colorado, as recorded in the real property records of Park County, Colorado at Reception No. 210375, Book 241, Page 708, on February 27, 1975 (the "Original Declaration"); 2. The Owners within the Kenosha Trout Club desire to amend and restate this Original Declaration; and 3. All of the owners of Lots within the Kenosha Trout Club have consented to the amendment and restatement of the Original Declaration; NOW, THEREFORE, effective this 27` day of April, 2000, all covenants, conditions, reservations, and restrictions effecting the Real Estate are consolidated, amended, and restated as follows: ARTICLE 1 DEFINITIONS Each term in this Declaration shall have the meaning specified or used in the Act, unless. otherwise defined in this declaration. ' "Act" shall mean the Colorado Common Interest Ownership Act, C.R.S. §38-33.3-101, et seq, as it applies to common interest communities created prior to July 1, 1992, as the Act may be amended.
