modification occurred otherwise, the cost of correcting such <br />condition shall be charged to the shareholder. The Board may <br />cause any unauthorized modification to be rectified to company <br />standards and the cost charged to the shareholder taking water <br />there from, and no water shall be delivered to any shareholder <br />through such structure until the cost of such correction has been <br />paid to the company. <br />SECTION 5: Delivery structures shall be so erected, maintained <br />and operated so the Ditch Rider can readily provide that each <br />shareholder shall receive only that proportion of water lawfully <br />running in the ditch to which that shareholder is lawfully entitled. <br />Once measured and turned out of the ditch for the account of a <br />shareholder, the management, use and enjoyment of the water so <br />delivered and the duty of complying with the iaw of Colorado <br />respecting use of such water is sole responsibility of the <br />shareholder. Water carried in the main ditch for delivery on <br />account of any share may only be used through the delivery <br />structure designated for that share unless the Ditch Rider shall <br />determine that it may be delivered elsewhere without injury to <br />other shareholders. Any decision by the Ditch Rider may be <br />appealed to the Board, whose determination shall be final. <br />SECTION 6: Shareholders may rent, loan or exchange water <br />when the Ditch Rider finds there is capacity in the main ditch to <br />effectuate the proposed change without impairing the operation of <br />the ditch or the exercise of the rights of other shareholders. <br />Whenever desirable for the efficient operation of the ditch, the <br />Board may require any proposed loan or exchange to be set forth in <br />writing and signed by shareholders involved before permitting a <br />loan or exchange. <br />SECTION 7: Whenever there is insufficient water available to <br />the ditch under its priority to fully supply all shareholders' <br />demands, the Ditch Rider may make such distribution of the water <br />9 <br />
