available as he finds most likely to effectuate an equitable <br />distribution to create the most advantageous use of the limited <br />supply available. Such distribution may include a proportional <br />delivery of water to all shareholders alike; or may provide a full <br />delivery to all shareholders in a section of the ditch for a limited <br />time, moving the section from portion to portion of the ditch as <br />may appear to the Ditch Rider to be calculated to make the most <br />equitable, efficient and effective use of the limited supply <br />available. If any shareholder is found to be receiving a supply of <br />water from the ditch beyond or in addition to his proper proportion <br />of the water in the ditch, the Board may curtail or terminate the <br />supply of water to that shareholder until that shareholder satisfies <br />the Board that adequate means have been worked out to remedy <br />the inequity. <br />SECTION 8: Existing practices long acquiesced in or approved <br />by the Board shall be deemed appropriate unless the Board orders <br />a specific change. The Board shall have authority to modify any of <br />the above requirements when it shall appear to it that such <br />modification will not impair the fair and lawful distribution of <br />water among the shareholders, but any such deviation shall be <br />deemed a special privilege subject to revocation at any time that it <br />shall appear to the Board that the deviation permitted was improper <br />or is permitting an unfair or unlawful pro rata distribution of water. <br />SECTION 9: Augmentation credits accruing to the Weldon <br />Valley Ditch Company resulting from water diverted and <br />recharged by the Company shall be allocated pro rata among the <br />shareholders of the Company. The augmentation credits allocated <br />include all augmentation credits resulting from ditch loss and <br />resulting from water recharged into the aquifer. The amount of <br />augmentation credits shall be net of pond evaporation losses and <br />any other losses charge by the State using whatever methodology <br />is approved in a water rights decree or administrative approval by <br />the State Engineer.
