<br />1 <br />9.2.1 Construction Plan -Not less than 30 days prior to construction or as soon as <br />possible for dams whose construction season is affected by freezing weather, the <br />engineer shall notify the State Engineer in writing of the date construction will begin, <br />the name of the engineer in charge of the project, and the name of the contractor. <br />' 9..2.2 Engineer Observation -The engineer shall observe, or provide for the <br />observation by a qualified technician directly responsible to the engineer, the <br />construction work on the dam, the cutoff trench, and outlet works foundation to see <br />that they are in substantial accordance with the approved plans. The engineer shall <br />endeavor to guard against defects and deficiencies in the construction of the dam, and <br />shall disapprove or reject work failing to conform to the approved plans and <br />specifications. <br /> 9.2.3 Inspection, Testing and Reporting -Tests of construction materials shall be <br /> taken and inspections of the construction made to verify that the work is completed in <br /> accordance with the approved plans and specifications. Periodic progress reports <br />' shall be submitted as requested by the State Engineer. The engineer shall compile a <br /> record of all tests conducted, and any problems and remedies, for submittal to the <br /> State Engineer at the end of construction. <br /> <br /> 9.2.4 Change Orders -Change orders shall be submitted in accordance with <br /> Rule 9.1.8. <br />' <br /> 9.2.5 Final Inspection -The engineer shall give the State Engineer at least 10 days <br /> advance written notice prior to the projects final construction inspection. <br /> <br /> 9.2.6 Completion of Construction -The engineer shall notify the State Engineer of <br /> the completion of construction in accordance with Rule 10. <br />' <br /> Rule 10. Acceptance of Construction of Jurisdictional Size Dams: <br />' 10.1 Acceptance of Construction -Construction for which application has been made <br /> pursuant to Rule 5 or Rule 6 shall not be deemed complete nor shall storage of water be <br /> permitted until the State Engineer furnishes to the owner a written statement of <br />acceptance, unless temporary approval of storage is granted by the State Engineer. The <br /> acceptance shall specify the vertical height, freeboard, length of the dam, the capacity of <br /> <br />' the reservoir in acre-feet, and any limitation upon, or requirements for the use of the dam. <br />The State Engineer shall furnish the acceptance or denial within 60 days of receipt of a <br /> complete notification of completion. <br />' 10.2 Construction Completion Documents -The engineer shall provide the following <br /> construction documentation within 60 days of the final construction inspection in order <br />' for the project to be deemed complete: <br />10.2.1 A written notification that the project is complete and m general conforms <br />with the approved plans, specifications and change orders; <br /> <br />
