The water activity is consistent with Section 3 7-75-102 Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br />The proposed water activity is not in conflict with existing protection of water rights, as described <br />in Section 37-75-102 of the C.R.S. <br />3. The water activity underwent an evaluation and approval process and was approved by the Basin <br />Roundtable (BRT) and the application includes a description of the results of the BRTs evaluation <br />and approval of the activity. At a minimum, the description must include the level of agreement <br />reached by the roundtable, including any minority opinion(s) if there was not general agreement for <br />the activity. The description must also include reasons why general agreement was not reached (if it <br />was not), including who opposed the activity and why they opposed it. Note- If this information is <br />included in the letter from the roundtable chair simply reference that letter. <br />The proposed water activity will be presented to the Colorado River Basin Roundtable on May 19, <br />2008. <br />4. The water activity meets the provisions of Section 37-75-104(2), Colorado Revised Statutes. The <br />requirements/language from the statute is provided in Part 3 of the Criteria and Guidelines. <br />A set of nine major "water management objectives" were developed and used to evaluate options for <br />addressing Colorado's future water needs through the Statewide Water Supply Initiative. The proposed <br />water activity meets four of these water management objectives: 1) enhance recreational opportunities, <br />2) provide for environmental enhancement, 3) promote cost effectiveness, and 4) comply with all <br />applicable laws, regulations, and water rights. <br />Currently, the reservoir does not support a fishery. The proposed water activity to reconstruct the dam <br />on Battlement Reservoir #3 will provide an estimated 1,000 angler recreation use days per year. The <br />completion of this proposed activity will allow the Colorado Division of Wildlife (CDOW) the <br />opportunity to reintroduce the native Colorado River cutthroat (CRC) trout to Battlement Reservoir #3. The CDOW <br />recognizes the CRC trout as a Species of Special Concern. Historically, the CRC trout occupied <br />portions of the Colorado River drainage across Wyoming, Colorado, Utah, Arizona, and New <br />Mexico (Behnke 1992; Behnke 2002). Multiple factors independently and synergistically, <br />however, have contributed to the decline of the CRC trout across the subspecies' historical range. <br />Behnke (1979) indicated that CRC trout occupy less than 1 % of the subspecies' historical range, <br />though a recent and rigorous assessment indicates that 14% may reflect a more accurate value <br />(Hirsch et al. 2006). <br />The "Conservation Strategy and Conservation Agreement for Colorado River cutthroat trout <br />(Oncorhynchus cla?kii pleuriticus) in the States of Colorado, Utah, and Wyoming, June 2006" <br />(CSCA) was signed and entered into agreement with other State, Federal, and Tribal agencies. The <br />proposed water activity directly addresses all four goals and two objectives of the Strategy and <br />Agreement.
