Box 969, Grand Junction, Co. 81502-0969
(970) 242-4343

March 24, 2008

Gordon Barker, President
and Lateral 135 Board
3042 Belford Court
Grand Junction, CO 81504

RE: Request for Assistance

Gentlemen:

We thank you for your written request for assistance. The Board of Directors of the Drainage
District appreciates a group making good faith effort to correct a situation on their own rather
than demanding that some agency rush to their side and make the problem go away.
Consequently the Board gave time and attention, reviewed your request, and then directed staff
to provide detailed estimates of materials, time, and labor for the District to consider.

Based upon a District survey of the site between Grand Valley Drive and Fruitwood Drive from E
Road south toward Gunnison Avenue the District's surveyor estimated somewhat less than 50%
of the volume of material originally requested. The equipment and personnel effort to transport,
fill, and level that material was estimated and costs assigned.

Based upon your successful plan of attaining other assistance for materials and installation
costs the Board decided to make the following offer.

1. The District is willing to assist Lateral 135 with the filling of the existing combination
headwater I wastewater ditch south of E Road. Drainage District personnel will load and
transport the fill material to the site, use District equipment to fill the existing combination
headwater I wastewater ditch, level the fill material so a. District trucks can back down
between the fences to unload the material and b. the contractor your group chooses may
get equipment in the easement area to lay pipes according to the plan identified in your
letter of February 25, 2008. Such transport of material and subsequent leveling would
occur after irrigation water is out of the ditches. Conditional upon Lateral 135
acceptance of the stipulations below the work will be scheduled for completion before
November 30, 2008.

2. District estimates that the loaders, tandem axle dump trucks, and skid steer loader
together with operators would constitute a value of $8,917 in District
e.ce", equipment time and labor costs. The value of the fill material
thE! Wau.rWay EaglE! purchased from a gravel provider in the area is estimated at $4,500.

3. In consideration of the District's participation the District wants the
irrigation supply line be piped all the way to the headgate so there is
no need for administrative spill into the District's Beswick Drain. It is
