In <br />developing the Watershed Plan the Ruedi Water and Power Authority will not identify, recommend or <br />include any legislation, regulations or policies ~~~lzich will diminish, in~pan•, or cause injury to any <br />property or cont~~actrral right created by intergovernmental agreements, contracts, stipulations <br />among parties to ~~~ater cases, ter°rus and conditions in ~~~ater° decrees, or any other similar document <br />related to the allocation or use of~~~ater. Findings or r•ecournrendations ofthe Watershed Plan 1~~ill <br />have rro force or effect in and of themselves butwill, rather, need to be adopted and enforced by local <br />governments or ~~~ater uranagement agencies in order to be inrplenrerrted. The Rrredi Water and <br />Power Authority carmot make commitments on behalf of its members but it ~~~ill urge those members <br />to adopt these same parameters 1~~hen taking any actions pzrrsuant to implementation of the <br />Watershed Plan ". <br />The applicant has also redrafted the grant application to address staff's concerns over conformance with <br />Section 37-75 -104 (2)(c). Specifically, the staff requested that the applicant address the bolded section of <br />the following excerpt from the statute: "Using data and information from the Statewide Water Supply <br />hutiative and other appropriate sources and in cooperation with the on-going Statewide Water Supply <br />I<utiative, develop abasin-wide consumptive and nonconsumptive water supply needs assessment, conduct <br />an analysis of available unappropriated waters within the basin, and propose projects or methods, both <br />structural and nonstn~ctural, for meeting those needs and utilizing those unappropriated waters where <br />appropriate. Basin Roundtables shall actively seek the input and advice of affected local governments, <br />water providers, and other interested stakeholders and persons in establishing its needs <br />assessment...." <br />The applicant's redrafted language in the current a~lication is provided below <br />"S'ection 37-7~-10-1 (2) provides for the strrcty ofwater needs and supplies ~~~ithin the respective basins <br />of the Basin Round Tables and r°ecor~mrerzdatiorzs based on those studies. The Roaring Fork <br />Watershed Plan is intended to carry out such a study and to provide such recor~mrendatiorrs on a <br />smaller scale, that is, within the confines of the Roaring Fork Watershed. The Roaring Fork <br />Watershed Plan will use ir~rfor•nration from the Statewide Water Supply Initiative, and many other <br />sources, to assess local creeds and resources and to develop recommendations for matching needs <br />~~~ith available supplies. The Plan has already solicited the active input of local governments, ~~~ater <br />urar7ager•s, stakeholders and interested citizens acrd will continue to do so in the course of Phase II of <br />the Plan. The Plan has and will corrtimre to include the input of orrt-of-basin interests, including but <br />not limited to, the Ti~~in Lakes Canal Company, the South East Water Conservancy District, and other <br />agencies ~~~ith responsibilities beyond the Roaring Fork y'aJJey such as the Brrrearr of Reclamation, the <br />Colorado Basin Roundtable (~~~hich has received r•egrdar°pr°ogress reports on the status ofPhase I of <br />the Plan), the Arkansas and Metro Basirr Roundtables, the Colorado Division of Water Resources and <br />the U. S. Forest Service. RWAPA ~~~i11 ask these beneficiaries and agencies to suggest and recomrrrend <br />other entities who Wright have an interest in the process and outcomes of the Watershed Plan and ~~~ill <br />provide those other entities ~~~ith inforrrration regarding the Plan and opportunities for input The <br />entities named above have participated in public meetings associated ~~~ith the planning process and <br />have provided feedback and data to the Plan.
