than January 2010 to allow time for additional data collection and analysis. Staff further
recommends that the Board consider entering into a formal written agreement with
JCWCD to allocate data collection and analysis responsibilities and to ensure progress
during the two year delay. A proposed agreement will be provided to the Board for
review and final approval at its March 200$ mieeting. Harris Sherman and Barbara btiggs
were not present for this motion. The motion was approved unanimously (8-0).
17. Stream and Lake Protection Section -Injury with Mitigation -Case No. 3-99CW34; Application
of Charles E. Nearburg

Action: A motion was made by Geoff Blakeslee and seconded by Eric Wilkinson to approve Staff
recommendation that the Board make the preliminary determination that the natural
environment of Trout Creek could be preserved to a reasonable degree with the proposed
injury if Charles ~learburg provides the proposed mitigation. Staff also requests that the
Board provide comments to Staff on the proposal and identify any issues that Charles
Nearburg and Staff should address before bringing the proposal to the Board for final
approval. The motion was approved unanimously (10-0).
18. Intrastate Water Management & Development Section -Water Supply Reserve Account Grant

Action: A motion was made by Harold Miskel and seconded by Eric Willcinson to approve up to
$150,040 for this project, with the following conditions:
(1) The Board send a message that this is an important part of the statute (that section
102) and the persons who intend to use these funds need to be cognizant of that, and
attempt to do the best job they can to comply with it; and
(2) Include a requirement that the additional issues and needs as expressed by Staff will
be met before any funds are upended. The motion was approved (10-0).
