<br />WHEREAS, in section 2.12 of both water service agreements the District recognized that <br /> <br />Denver Water will implement Denver Water's Conservation Master Plan dated Decenlber 1, <br /> <br />1992 ("Conservation Master Plan"), as amended and updated, in order to encourage wise use of <br /> <br />water throughout the existing and projected service areas of all of the Distributors to whom <br /> <br />Denver Water has made a commitment to furnish water; and <br /> <br />WHEREAS, in section 2.12 of both water service agreements the District agreed to assist <br /> <br />Denver Water in implementing the Conservation Master Plan by, among other things, supporting <br /> <br />the Conservation Master Plan with its customers, contributing ideas and suggestions to Denver <br /> <br />Water regarding water conservation, encouraging the public to use 10\'v flow plumbing fixtures <br /> <br />and low water use landscaping techniques, using low flow plumbing fixtures and low water use <br /> <br />landscaping teclmiques at its facilities whenever mo,difications are made to such facilities, <br /> <br />conducting a leak detection and repair program on its system that is acceptable to Den\'er Water <br /> <br />and the District, and disseminating information and materials about the Conservation Master <br /> <br />Plan to its customers, an.d imposing penalty charges on wasteful consumption during tiInes of <br />restrictions; and <br /> <br /> <br />WHEREAS, Denver Water has adopted "Tap-Smart: The Conservation Master Plan" <br /> <br /> <br />("Tap-Smart Plan"), \vhich is an amended ~d updated version of the Conservation Master Plan; <br /> <br /> <br />and <br /> <br />WHEREAS, section 37-60-126(2)(a), C.R.S. (2007), provides that each covered entity <br /> <br />shall,develop, adopt, make publicly available, and implement a plan pursuant to which such <br /> <br />covered entity shall encourage its domestic, commercial, industrial, and public facility custoln~rs <br /> <br />to use water ITIOre effi?iently; and <br /> <br />\\lHEREAS, the District is a co\'ered entity as .defined in sectiOI13<7-60-126(1)(a). <br /> <br />2 <br /> <br />..
