THtRD: Whereupon the Court proceeded to hear all the
evidence offered, and having heard such evidenoe and being fully
advised in the premises, doth find as follows: That The Big
Thompson Ditch and Manufacturing Company's Ditch No.2 is an irrigating
ditoh with its headgate 10oa,ted in Seotion 15, ToWnship 5, North,
Range 69 West, being in Water Distriot No.4, and takes its prio-
rities from the Big Thompson, River; that in the general adJudica-
tion deoree entered in the County of Boulder on the 28th day of
May, 1883, there was decreed to the said The Big Thompson Ditch
and Manufacturing Company's Ditch No.2, the following priorities:
Priority No.2 for 34.02 cubic feet of water per second of time,
of date April 1st, 1863, Pr1.ority No.4 for 37.01 cubic feet of
water, of date May 1st, 186~f, Priority No. loifor 65,47 cubic

feet of water, of date March 1st, 1867, and Priority No. 20, for
9~75 cubic feet of water,' of' date May 1st, 1872, making a total of
146.25 cub'1c feet of water per second of, time.
FOURTH: That the said The Big Thompson Ditch and Manufact-
uring Company's Ditch No.2 is a mutual Ditch Company, and that the
ownership of two shares of its capital stock, entitles the owner
thereof to six cubic feet of' water per secdnd ot time of said pri-

sferred from the intake and headgate of the Big Thompson Ditoh &
Manufacturing Company's Di tClh No. 2 to the headgate and intake of

rities, with headgate 10catEld in Seotion 2, township 5, North,
Range 70 West, receiving wa1~er from the Big Thompson River.
FIFTH: That peti tionE!r is the owner of a farm consisting

of the Big Thompson Ditch & Manufaoturing Company's Ditch No.2, and
