ON PETITION OF JOHN SWARTZ FOR CHANGE
OF POINT OF DIVERSION OF J~ PORTION OF
THE WATER FROM THAT DITCH KNOWN AS THE
BIG THOMPSON DITCH & MAmn~ACTURING COM-
PANY'S DITCH NO.2, TAKINO WATER FROM THE
BIG THOMPSON RIVER.

And now on this 23rd day of March, 1914, this cause coming
on to be heard on pet! tiol'1 of' peti tioner, there appeared
John H. Simpson as attornl~y for petitioner and L. R.
Rhodes of counsel, and it appearing that no protest or object-
ion has" been filed, the cl:>urt proceeded to hear the evidence
offered, and being fully ,advised in the premises, makes the
foll~wing findings:
FIRST: That petitioner John Swartz filed his
petition in this, court on the 15th day Ot NOvember-19l3, and

presented to the Court said petition, whereupon the Court
entered an order requiring service of notice and copy of order
as by statute required, and fixed a.day for hearing.
SECOND: That a copy of said notice and or der
has been duly served upon. all appropriator~ of water, as shown
by the decrees entered in. the. District Court of the County of
Boulder in and for Water District No.4, the same having been
served as required by said notice and by the Statutes of the
State of COlorado, proof of service having been tiled herein.
