11. Water Supply Protection Section - Navajo-Gallup Project Support <br />Tape 1, Track 1 03:05:30 - 03:16:47 <br />Action: A motion was made by Don Schwindt, and seconded by John Redifer to approve <br />staff recommendation that the Board support sending the letter (shown in the <br />Board notebook and on CWCB's website) wluch supports the NGWSP and also <br />requests a legislative mandate that the USF&WS conduct a PBO as part of <br />Colorado's support for the legislation. The letter also opposes Arizona's position <br />on water diverted from the Upper Basin for use in the Lower basin. Copies of <br />the letter would be transmitted to the Department of Interior, Bureau of <br />Reclamation, Ne~y Mexico and the other Colorado River Basin States, and to <br />Colorado's Congressional Delegation. The Board ~~-ould like the first sentence of <br />paragraph three of the letter reflecting Arizona's position to be changed to read, <br />"Arizona has proposed that any depletion of ~yater in Arizona, from the San Juan <br />River in New Mexico that results from the diversion of ~yater by the NGWSP for <br />uses withni Arizona, upon completion of a settlement agreement between the <br />Navajo Nation and Arizona (approiimatehT 6,400 AF), should be accounted for <br />as part of the 2.8 MAF of Colorado River mai<istem water apportioned to <br />Arizona in Article II(B)(1) ofthe Supreme Court Decree itiAt°isona v <br />Cali or•nia." With the changes to the language describing Arizona's position and <br />not Colorado's, the motion was approved unanimouslyT (9-0). <br />12. The motion was approved unanimously (9-0). <br />Executive Session Items <br />Tape 0, Track 0 00:00:00 - 00:00:00 <br />Action: Based upon the recommendation from Casey Shpall, Deputy Attorney General, <br />the discussion of Agenda Items 12b-12e were not recorded pursuant to C.R.S. <br />section 24-6-402(2)(d.5)(I)(B) because those portions ofthe Eiecutive Session <br />constituted privileged attorney-client communications. Agenda Item 12a ~yill not <br />be discussed as this matter has been settled. <br />CWCB Attorney <br />The portion ofthe Executive Session on Agenda Items 12b-12e that were not <br />recorded were confined to the topics authorized for discussion in ali Executive <br />Session under C.R.S. section 24-6-402(3)(a)(II). <br />CWCB Chair <br />Action: A motion «as made by Keith Catlin and seconded by Harold Miskel to end <br />Executive Session.
