Report fi-om Executive Session <br />Tape 1, Track 1 03:23:16 - 03:23:29 <br />Action: Casey Shpall, Deputy Attorney- General, reported that Agenda Items 12b-12e ~~~as <br />discussed in Executive Session Ind were limited to litigation strategies. <br />Meeting Recessed 5:55 p.m. <br />Wednesday-, September 19, 2007 <br />Call to Order (8:06 a.m.) <br />A regular meetnig of the Colorado Water Conservation Board (CWCB) «as convened at the <br />Doubletree Hotel, 7~3 Horizon Drive, Grand Junction, CO 81506. The meeting was called to <br />order by Chair Travis Smith. Eight voting members were present at the call to order so a quorum <br />was present (at least sir required). Voting Board members present were Chair Travis Smith, Vice <br />Chair Don Sch«indt, John Redifer, Keith Catlin, Harold Mislcel. Carl Trick, Eric Will~inson, and <br />Geoff Blakeslee. Also present ~~as Alegi Davis. representing Harris Sherman, Executive Director <br />of the Department of Natural Resources. Non-voting Ex Officio members present or represented <br />~~~ere CWCB Acting Director Dan McAuliffe, Dick Wolfe representing the State Engineers <br />office, Jim Miller, representing the Colorado Agriculture Commissioner, and Casey Shpall, <br />Deputy- Attonie~- General. First Assistant Attorney General Susan Schneider was also present. <br />14. Stream and Lake Protection Section -Uncontested 2007 histream Flo«_ Appropriation - <br />Water Division 6 -Beaver Creek -Moffat Countti-. <br />Tape 2, Track 1 00:00:00 - 00:19:05 <br />Action: A motion ~~ as made b~- Don Schwindt and seconded by John Redifer to approve <br />staff recommendation that the Board: <br />1) determine, pursuant to section 37-92-102(3), CRS, and based upon the <br />recoimnendation of the BLM, a review of the data and other information <br />presented b~- staff, >li the memo (attached in the Board notebook and on the <br />CWCB website) and orally, staff's recommendation for instream floe- <br />appropriations on the streams identified that: <br />(a) A natural enviromnent does eiist on Beaver Creek; <br />(b) Water is available in the stream for appropriation; <br />(c) The natural enviromnent will be preserved to a reasonable degree b~- the <br />water available for the recommended appropriations; <br />(d) There is a natural enviromnent that can be preserved to a reasonable <br />degree with the recommended water rights, if granted, and <br />(e) Such natural environment can eiist «-ithout material injury to «%ater <br />rights. <br />2) Pursuant to Rule Sf, establish December 31, 2007 as the appropriation date for <br />these instream flow water rights. <br />3) Request the Attoriev General's Office to file the necessary water rights <br />applications not later than December 31, 2007.
