Meeting Recessed 5:55 p.m. Wednesday-, September 19, 2007 Call to Order (8:06 a.m.) A regular meetnig of the Colorado Water Conservation Board (CWCB) «as convened at the Doubletree Hotel, 7~3 Horizon Drive, Grand Junction, CO 81506. The meeting was called to order by Chair Travis Smith. Eight voting members were present at the call to order so a quorum was present (at least sir required). Voting Board members present were Chair Travis Smith, Vice Chair Don Sch«indt, John Redifer, Keith Catlin, Harold Mislcel. Carl Trick, Eric Will~inson, and Geoff Blakeslee. Also present ~~as Alegi Davis. representing Harris Sherman, Executive Director of the Department of Natural Resources. Non-voting Ex Officio members present or represented ~~~ere CWCB Acting Director Dan McAuliffe, Dick Wolfe representing the State Engineers office, Jim Miller, representing the Colorado Agriculture Commissioner, and Casey Shpall, Deputy- Attonie~- General. First Assistant Attorney General Susan Schneider was also present. 14. Stream and Lake Protection Section -Uncontested 2007 histream Flo«_ Appropriation - Water Division 6 -Beaver Creek -Moffat Countti-. Tape 2, Track 1 00:00:00 - 00:19:05 Action: A motion ~~ as made b~- Don Schwindt and seconded by John Redifer to approve staff recommendation that the Board: 1) determine, pursuant to section 37-92-102(3), CRS, and based upon the recoimnendation of the BLM, a review of the data and other information presented b~- staff, >li the memo (attached in the Board notebook and on the CWCB website) and orally, staff's recommendation for instream floe- appropriations on the streams identified that: (a) A natural enviromnent does eiist on Beaver Creek; (b) Water is available in the stream for appropriation; (c) The natural enviromnent will be preserved to a reasonable degree b~- the water available for the recommended appropriations; (d) There is a natural enviromnent that can be preserved to a reasonable degree with the recommended water rights, if granted, and (e) Such natural environment can eiist «-ithout material injury to «%ater rights. 2) Pursuant to Rule Sf, establish December 31, 2007 as the appropriation date for these instream flow water rights. 3) Request the Attoriev General's Office to file the necessary water rights applications not later than December 31, 2007.
