Anne: Any info on what benefit, outcome, comes of that membership?

Rick: They have water projects that cause depletions, come under the umbrella of depletion as
part of 3 -state agreement.

Anne: And that actually benefits them?

Rick: Not yet, isn't there a Biological Assessment that will address those issues, and that's
where these entities will be impacts will be mitigated.

Anne: And that gets ruled on by the Court?

Ronda: Fish and Wildlife will decide under Section 7 consultation, Corps will approve it.

Rick: They will write that.

Mary: TT will write the BA, F&W will write the BO.

Rick: They will give their opinion that our membership will be covered. Weare having effects
on endangered species, but the ones down in Nebraska, they will be covered by the 3-state
agreement.

Anne: Did you joint for a past depletion? Do you need a new membership each time you have a
new depletion?

Rick: Only started 2 years or so ago. You can have more than one depletion and have them
covered by the SPW AP. Works for 13 years, then it gets refigured. Some people had depletions
before the SPW AP was there and they had to make replacements down in Nebraska. This is the
new era that the SPW AP is the new way to mitigate those.

Tom: Alan Berryman gave a good presentation last week, and at the website. SPW AP.org, I
believe. Thanks for the update on that. Other Items?

Tom: Does not fit in this meeting, will move to coordination meeting There was a conference
call in the last few days. To talk about the economics, the bottom line, we are in good shape for
now, looking at the cost of reallocation in Chatfield vs. the alternative, the no-action alternative,
what is the next least costing alternative, the numbers are working out fine right now. Taking
those fears out of the costs. Piece of good news.

Rick: Part of the preliminary DEIS, think it's ready to go.

Tom: 8 and 9 covered, and now, roundtable? Other items?

Rick: Talk about this committee whose name we are not sure of. Committee that brought out the
hiring ofEDAW as an accomplishment. Trying to find somebody being a facilitator/advocate/on
behalf of water users, and we have talked with various people, scheduled interviews, not at a

13
