Western States Water Council
Water Quality Committee

Boise, Idaho
April 21, 2005

.

Paul Frohardt-not sure that holding the discussion at NARF symposium is the best forum. That
is more for water resources folks, and less of a draw for WQ.

Toni said Idaho is interested in the topic. She agreed that the symposium is not the best forum.
It is a big issue for ID, and she is wanting to spend time on it.

Dean Couch (OK)-he would support the committee pursuing the issue also. They have 39
tribes in Oklahoma. The first tribe was approved for T AS status. Standards are yet to be developed.
Agrees NARF symposium is not the right forum.

Bill Hurne-Pueblo Isleta established standards more strict than Albuquerque'. Went all the way
to Supreme Court, and the City lost all the way. We better work on this, because tribes have the
authority!

Susan Burke-In ID, depends on tribe. EP As involvement is also an issue. Region didn't know
what HQ was doing. Need to have EPA involved!!

Paul Frohardt-Gary Hudiburgh expressed support in having EP A involved in these discussions.

Dean Couch (OK)-HQ and Region 6 were not on the same page in OK experience.

.

Stephen Bernath-Washington has not had the issue come up. They havethe reverse issue.
State adopting standards, and EP A has been working with tribes, and will try to stop state from going
where it wants.

Paul Frohardt-Where do we go? Toni Hardesty suggested a special meeting on 518/TAS tied
into a future Council meeting.

Bill Hume-EPA is the follower rather than instigator. Need to work with tribes.

Toni (ID) - need to do better job on developing agenda. EPA could tell us for which tribes
(which states) this is an issue.

Shaun will contact EP A regarding possible grant money for a meeting and this new program;
individual states will need to help identify the tribes and get them there.

Paul Frohardt-said he believes subcommittee is needed to work on this workplan item.
Volunteers: Dean Couch, Bill Hurne, Bernath will ask for WA tribal liaison, Susan Burke, Idaho

Shaun will set up a call to discuss how to move forward, First item of business is to finalize the
WGA letter to EP A.

.

8
