Community corrections program <br />not a private correctional facility. <br /> <br />Notwithstanding any provision of this Char- <br />ter, a community corrections program as defined <br />in Article 27, Title 17, Colorado Revised Stat- <br />utes, or corresponding section of successor leg- <br />islation" shall not be considered a private cor- <br />rectional facility as defined in Section 14-1 of <br />this Charter. <br /> <br />Sec. 14.3. Private correctional facility <br />operator defined. <br /> <br />I <br />I <br />I <br />I <br /> <br />The term "private correctional facility <br />operator" when used in this Charter shaH mean <br />any person, corporation, partnership, business, <br />association, limited liability company, govern- <br />ment enterprise (as defined in Article X, Section <br />20 of the Colorado Constitution), or any other <br />entity that is not an agency or political subdivi- <br />sion of the State of Colorado nor an agency of <br />the Fedleral government, which operates or seeks <br />to operate a private correctional facility. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Sec. 14-4. Limitations on construction and <br />operation. <br /> <br />No private correctional facility operator may <br />construct or operate a private correctional facil- <br />ity within the City of Lamar except as allowed <br />for in Section 14-5 of this Charter. Nor shall the <br />City oJ Lamar expend any funds on, nor shall <br />any city employee in his official capacity engage <br />in, the recruitment or promotion of any private <br />correctional facility proposed to be built within <br />Prowers County except as allowed for in Section <br />14-5 of this Charter. <br /> <br />Sec. 14-5. Authorization powers regarding <br />construction and operation of <br />facilities reserved to people of <br />Lamar. <br /> <br />The powers to authorize construction or <br />operation of a private correctional facility within <br /> <br />Supp.3 <br /> <br />the City of Lamar; to authorize the City of <br />Lamar to expend funds or staff time on the <br />recruitment or promotion of a private correc- <br />tional facility proposed to be built within Prow- <br />ers County; and, to authorize city..owned utilities <br />to provide water or wastewater services to a pri- <br />vate correctional facility, are rl;~served to the <br />people of Lamar, and said authorization may <br />only be granted by the eligible electors of the <br />City of Lamar, at a municipal election, on an <br />initiated or referred measure. Any question <br />submitted to the people of Lamar pursuant to <br />this section shaH include, at a minimum: the <br />name of the prospective private correctional <br />facility operator, the maximum inmate capacity <br />of the facility, what jurisdictions may place <br />inmates in the facility, and not kss than one or <br />more than five locations at which the private <br />correctional facility might be lociLted. <br /> <br />Adopted in Convention this 24th day of May, <br />1962, and signed in triplicate: <br /> <br />Roland Green, <br />President <br />H.
