Assignment. <br /> <br />Assignment or leasing of a franchise shall be <br />considered a forfeiture unless application there- <br />for be made to the City, and consent given by <br />the Council by ordinance, with such change of <br />conditions or terms as they may deem necessary. <br />Council, reserves the right to deny any assign- <br />ment of franchise. <br /> <br />Sec. 12-13. Books and records. <br /> <br />The Council shall cause to be kept in the <br />office of the City Clerk, an indexed franchise <br />record in which shall be transcribed copies of all <br />public utility franchises heretofore and hereafter <br />grantedl. The index shall give the name of the <br />grantee and any assignees. The record shall be a <br />complete history of all such franchises and shall <br />include a comprehensive and convenient refer- <br />ence to all actions at law affecting the same, and <br />copies of all annual reports, and such other mat- <br />ters of information and public interest as the <br />Council may from time to time require. <br /> <br />Article XIII <br />Transitional Period <br /> <br />Sec. 13-1. Status of transitional provision. <br /> <br />Tht: purpose of this article is to provide for <br />an orderly transition from the present City gov- <br />ernment to a home rule government under the <br />provisions of this Charter. This article shall <br />constitute a part of this Charter during the tran- <br />sition :period. <br /> <br />Sec. B-2. Transition period. <br /> <br />The period from the effective date of the <br />Charter to January I, 1963, shall be known as <br />the "transition period." During this period all <br />officers and employees shall proceed with due <br />diligence to put into effect the provisions of this <br />Charter. During the transition period the Coun- <br />cil sh~11 designate by resolution provisions of the <br /> <br />Supp.3 <br /> <br />Charter to become operative. Resolutions shall <br />fix the dates on which and the agency or agen- <br />cies to which each provision becomes operative. <br />Until superseded by this Charter, or any provi- <br />sion thereof, the state statutes shall be in effect. <br /> <br />Sec. 13-3. Present Council andl Mayor to <br />continue in office. <br /> <br />The Council and Mayor, or their appointed <br />successors, in office at the time of the adoption <br />of this Charter shall continue at their present <br />salaries to serve and carry out the functions, <br />powers and duties of their offices until the 10th <br />day of September, 1962. <br /> <br />Sec. 13-4. Retirement plans. <br /> <br />This Charter shall not affect any contractual <br />relationships existing on the effective date of <br />this Charter between the municipal government <br />and any officer or employee by reason of any <br />retirement plans in effect. <br /> <br />Sec. 13-5. Local improvements. <br /> <br />Local improvements not completed on the <br />effective date of this Charter shall be governed <br />until completed by the ordinance under which <br />they were commenced. <br /> <br />Article XIV <br />Correctional Facilities <br />(Ord. 1078 passed at <br />November 1, 2005 elel:tion) <br /> <br />Sec. 14-1. Private correctional facility <br />defined. <br /> <br />The term "private correctional facility" when <br />used in this Charter shall mean any facility that <br />is used or intended to be used for the incarcera- <br />tion of adults and that is owned or operated by a <br />private correctional facility operator, or pro- <br />posed to be owned or operated by a private cor- <br />rectional facility operator. <br /> <br />C-25 <br />
