No liability without <br />appropriation. <br /> <br />Exct:pt as herein otherwise specifically pro- <br />vided, the City expenditures in anyone year <br />shall not be increased over and above the <br />amount provided in the annual appropriation <br />ordinance, and no contract involving the expen- <br />diture D)f any improvement to be paid out of the <br />general or special funds of the City or defraying <br />the expenses and liabilities of the City shall <br />exceed, in anyone year, the amount provided in <br />the annual appropriation ordinance to be paid <br />out of the said general and special funds so <br />appropriated and set apart, but the said several <br />funds shall be maintained for, used and devoted <br />to the particular purposes specified in the annual <br />appropriation ordinance. <br /> <br />I <br />I <br /> <br />I <br /> <br />Sec. 11-21. Capital improvements <br />appropriations. <br /> <br />I <br /> <br />Appropriations for construction or other <br />permanent improvements from the capital <br />improvements fund shall not lapse until the pur- <br />pose for which the appropriation was made shall <br />have been accomplished or abandoned; pro- <br />vided, any project shall be deemed to have been <br />abandoned if three fiscal years elapse without <br />any expenditure from or encumbrance of the <br />appropriation therefor. Any unappropriated bal- <br />ance in the capital improvements fund may be <br />transfelTed by the Council and used for the pay- <br />ment of outstanding bonded indebtedness of the <br />City. <br /> <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Part 3, Bonded Indebtedness <br /> <br />Sec. 11-22. General obligation bonds. <br /> <br />Council shall have power to issue general <br />obligation bonds of the City for any public pur- <br />pose, upon majority vote of the electors of the <br />City voting at any special or general election; <br /> <br />provided, that water bonds may be issued with- <br />out an election upon a detemlilnation to that <br />effect by Council, The total outstanding general <br />obligation indebtedness of the City, other than <br />water bonds, shall not at any time exceed ten <br />percent of the assessed valuation of the taxable <br />property within the City, as shown by the last <br />preceding assessment for tax purposes. General <br />obligation bonds of the City, other than water <br />and utility bonds, shall mature in not more than <br />twenty years from date and shall be payable in <br />annual installments commencing not later than <br />five years after date of said bonds. Water and <br />utility bonds shall mature and be payable as pro- <br />vided by ordinance authorizing the issue of said <br />bonds. (Ord. No. 647, passed at Nov. 6, 1973 <br />election) <br /> <br />Sec. 11-23. Revenue bonds. <br /> <br />The City may issue revenue bonds for any <br />public purpose without first submitting the <br />question of their issuance to the qualified elec- <br />tors, and may pledge the reve:nues from the <br />income-producing project to pay the bonds and <br />interest thereon; provided that ifany such bonds <br />pledge the revenue of any other City-owned <br />utility, property or facility, or if the said bonds <br />are in any way made a general obligation of the <br />City, then such bonds shall require the affimla- <br />tive vote of a majority of the q~lalified electors <br />voting thereon before they may be issued; except <br />issuance of revenue bonds on the electric utility <br />must be approved by a majority of the whole <br />Utilities Board at a regular meehng. (Ord. No. <br />647, passed at Nov. 6, 1973 election) <br /> <br />Sec. 11-24. Refunding bonds. <br /> <br />Council may authorize, by ordinance, with- <br />out an election, issuance of refunding bonds for <br />the purpose of paying or providing for the pay- <br />ment by escrow deposit or otherwise outstanding <br />bonds of the City, including special improve- <br />ment bonds. <br /> <br />C-21 <br />
