<br />Russ Geo rge asked those at the table familiar with contracting if it was common practice for <br />contractors to reach beyond their own expertise in forming a team for a project such as this one, <br />and got an affirmative response from several members of the group. <br /> <br />Addit ional discussion focused on the following questions, which will be addressed in the next <br />Committee conference call : <br /> <br />? <br /> <br />If the RFQ results in one prime contractor with many sub - contractors, how do we assure <br />adequate interface and communication between all inv olved ? <br />? <br /> <br />Have R oundtables gone far enough in their process to even know what assistance they <br />will require to complete their needs assessments, the questions they should be asking of a <br />contractor and what kind of expertise they might need? <br />rd <br />? <br /> <br />With responses to the RFQ due on August 23 , there was a concern that there would not <br />be adequate time to consult Roundtables on the proposed approach to securing consulting <br />assistance or feedback on the RFQ . Conversely, there was a desire to not hold up the <br />contracting process and to get people with technical assistance on board. <br />? <br /> <br />There was a concern that the work of a future contractor not be duplicative of work that <br />has already been done by other providers of technical assistance. F or example, many <br />people are curre ntly studying potential water requirements for energy development. The <br />group did not want the contractor’s efforts to repeat other’s work. (Response: Eric Hecox <br />commented that the RFQ states that the selected contract must use available data to the <br />maxim um extent possible, and based on the questions he has been asked during the <br />bidding process, it appears contractors are reaching out to others working on similar <br />topics so that they will be able to secure this information .) <br />? <br /> <br />If IBCC members serve as a part of a contractor team bidding for this work, does that <br />create a conflict of interest? If there is cross - over participation, would it be possible to <br />separate that person from the appearance of conflict in other ways – such as not working <br />on the needs assess ment for the basin they represent? Even if there would be no legal <br />problem, would that person’s participation cloud the results in a way that is not worth the <br />trouble? <br /> <br />A number of IBCC members stated that involvement on a contractor’s team might be a <br />p roblem. There was a general d esire to avoid even the appearance of impropriety or a <br />potential conflict of interest. Russ George noted that this can be avoided by full <br />disclosure. He felt that an IBCC member serving on a contractor’s team would be fine <br />( with full disclosure) but that member could not be part of any selection process. <br /> <br />? <br /> <br />If the selected contractor has the option, or the requirement, to seek out additional expertise <br />through sub - contractors once the contract has begun, how will the State have a voice in that <br />process? <br /> <br />? <br /> <br />There was a c oncern that the IBCC and the state needs to identify a project manager who will <br />actively manage the process on behalf of the state. <br /> <br /> 3 <br />
