<br />. <br /> <br />B. EqJlal Opportunity Laws <br /> <br />. <br /> <br />. <br /> <br />In connection with the performance of the WORK under this Contract, <br />CONTRACTOR agrees not to refuse to hire, discharge, promote or demote, or <br />discriminate in matters of compensation against any person otherwise qualified, <br />solely because of race, creed, sex, color, age, national origin, or ancestry; <br />CONTRACTOR further agrees to insert the foregoing provision in all subcontracts <br />hereunder. <br /> <br />.' <br /> <br />Colorado labor shall be employed to perform the WORK herein to the extent of not <br />less than 80% of each type or class of labor in the several classifications of skilled <br />and common labor employed on the project. The term "Colorado labor" shall mean <br />any person who is a resident of the State of Colorado. Preference shall be given to <br />Colorado labor, supplies, materials, and provisions produced, manufactured, or <br />grown in Colorado, quality being equal to articles offered by competitors outside the <br />State. <br /> <br />. <br /> <br />C. Waiver <br /> <br />Any waiver on behalf of DISTRICT of any breach of any of the covenants and <br />obligations of CONTRACTOR under this CONTRACT shall not be effective .or <br />. binding upon DISTRICT unless the same be expressed in writing, and any waiver so <br />expressed shall not limit or affect DISTRICT's rights under this CONTRACT with- <br />respect to any other or future breach. <br /> <br />8. TERMINATION <br /> <br />. <br /> <br />This CONTRACT shall be effective as of date shown on CONTRACT and shall continue <br />until CONTRACTOR satisfactorily completes the work hereunder or until earlier <br />terminated by DISTRICT in accordance with the provisions of this Section. The following <br />work performed by CONTRACTOR will be closely monitored by the DISTRICT: <br /> <br />. <br /> <br />. <br /> <br />A. Compliance with the contract specifications <br />B. Accomplishing each scheduled mowing & debris pickup on time <br />C. Quality and quantity of extra work performed <br />D. Timely payment of all employees, subcontractors and suppliers <br />E. Response time to request for extra services <br /> <br />. <br /> <br />Abuse of anyone or all of the above items will be cause for immediate termination of the <br />CONTRACT. Not withstanding the above, the DISTRICT may, without cause, terminate <br />this CONTRACT at any time by giving CONTRACTOR ten (10) days' written notice <br />thereof. Upon termination, DISTRICT shall pay for only the services and work performed <br />by CONTRACTOR to the date of termination and not for any costs incurred subsequent <br />thereto, including profit margins on the remaining work. CONTRACTOR may, without <br />cause, terminate this CONTRACT at any time by giving DISTRICT ten (10) days' written <br /> <br />. <br /> <br />23 <br />
