In connection with the performance of the WORK under this Contract, CONTRACTOR agrees not to refuse to hire, discharge, promote or demote, or discriminate in matters of compensation against any person otherwise qualified, solely because of race, creed, sex, color, age, national origin, or ancestry; CONTRACTOR further agrees to insert the foregoing provision in all subcontracts hereunder. .' Colorado labor shall be employed to perform the WORK herein to the extent of not less than 80% of each type or class of labor in the several classifications of skilled and common labor employed on the project. The term "Colorado labor" shall mean any person who is a resident of the State of Colorado. Preference shall be given to Colorado labor, supplies, materials, and provisions produced, manufactured, or grown in Colorado, quality being equal to articles offered by competitors outside the State. . C. Waiver Any waiver on behalf of DISTRICT of any breach of any of the covenants and obligations of CONTRACTOR under this CONTRACT shall not be effective .or . binding upon DISTRICT unless the same be expressed in writing, and any waiver so expressed shall not limit or affect DISTRICT's rights under this CONTRACT with- respect to any other or future breach. 8. TERMINATION . This CONTRACT shall be effective as of date shown on CONTRACT and shall continue until CONTRACTOR satisfactorily completes the work hereunder or until earlier terminated by DISTRICT in accordance with the provisions of this Section. The following work performed by CONTRACTOR will be closely monitored by the DISTRICT: . . A. Compliance with the contract specifications B. Accomplishing each scheduled mowing & debris pickup on time C. Quality and quantity of extra work performed D. Timely payment of all employees, subcontractors and suppliers E. Response time to request for extra services . Abuse of anyone or all of the above items will be cause for immediate termination of the CONTRACT. Not withstanding the above, the DISTRICT may, without cause, terminate this CONTRACT at any time by giving CONTRACTOR ten (10) days' written notice thereof. Upon termination, DISTRICT shall pay for only the services and work performed by CONTRACTOR to the date of termination and not for any costs incurred subsequent thereto, including profit margins on the remaining work. CONTRACTOR may, without cause, terminate this CONTRACT at any time by giving DISTRICT ten (10) days' written . 23
