Subcontractin~ <br /> <br />. <br /> <br />CONTRACTOR may utilize the services of subcontractors on those parts of the work <br />which, under normal contracting practices, are performed by subcontractors. <br />CONTRACTOR shall not award work to subcontractor(s), in excess of fifty (50%) <br />percent of the maximum CONTRACT amount without prior written approval of <br />DISTRICT. <br /> <br />. <br /> <br />CONTRACTOR shall be fully responsible to DISTRICT for the acts and omissions <br />of his subcontractor(s), and of persons either directly or indirectly employed by them, <br />as he is for the acts and omissions of the persons directly employed by him. <br />CONTRACTOR shall cause appropriate provisions to be inserted in all subcontracts <br />relative to the work to bind subcontractors to CONTRACTOR and to the terms of the <br />CONTRACT DOCUMENTS insofar as applicable to the work of subcontractor(s). <br />CONTRACTOR shall retain the same power as regards terminating any subcontract <br />that DISTRICT may exercise over CONTRACTOR under any provision of the <br />CONTRACT DOCUMENTS. <br /> <br />. <br /> <br />E. <br /> <br />Protection of Public Utilities and Adjacent Property <br /> <br />.. <br /> <br />Due care shall be exercised by CONTRACTOR to avoid damage to existing <br />improvements and facilities the CONTRACTOR will be working around, adjacent <br />public or private property, landscaping, trees, and shrubbery. Any damage to said <br />property caused by CONTRACTOR shall be repaired or replaced at <br />CONTRACTOR's expense in an expeditious manner and to the satisfaction of the <br />owner of the damaged property. <br /> <br />. <br /> <br />F. <br /> <br />Maintainin~ Traffic <br /> <br />. <br /> <br />1. General - Whenever CONTRACTOR's operations create a potentially <br />hazardous condition to traffic or to the public, CONTRACTOR shall take the <br />necessary precautions and provide adequate means to protect those who must <br />pass through or over the work. CONTRACTOR is hereby notified that all <br />lights, signs, barricades, flagmen, or other devices necessary to provide for <br />public safety shall be furnished, installed, and maintained by CONTRACTOR. <br />DISTRICT mllY, but is not required to, point out the inadequacy of protective <br />devices or measures, but such action or lack of action on the part of DISTRICT <br />shall not relieve CONTRACTOR from responsibility for the public safety or <br />abrogate his obligation to furnish these devices. <br /> <br />. <br /> <br />. <br /> <br />2. Trail - In most cases, the trail will be used by CONTRACTOR for access to the <br />river in the execution of this contract. CONTRACTOR shall not park vehicles <br />on the trail or otherwise generally block the trail.
