<br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />this CONTRACT and said work cannot be effectively completed without <br />blocking the trail, signs shall be posted to provide trail users with adequate <br />warning of said obstruction. <br /> <br />In the execution of the debris removal portion of this contract, material <br />removed from the channel shall not be stockpiled any closer than 10- feet to the <br />edge of the concrete recreational trail. All debris stockpiled for purposes of <br />drying out shall be removed and hauled off by 5 p.m. of each work day. <br />Similarly, any mud, dirt, debris, or ether material that is deposited onto the trail <br />during the execution of this contract shall be thoroughly removed from the trail <br />surface by 5 p.m. of each work day. <br /> <br />4. <br /> <br />CHANGES IN WORK <br /> <br />A. <br /> <br />Change Orders <br /> <br />If DISTRICT amends or changes the scope of work made reference to herein, <br />through the use of a CHANGE ORDER, an appropriate adjustment of the fixed price <br />and completion date under this CONTRACT DOCUMENT, if justified, shall be <br />mutually agreed to by the Parties hereto. No such CHANGE ORDER nor any other . <br />modifi~ation of the CONTRACT DOCUMENTS shall be made except in writing and <br />signed by DISTRICT and CONTRACTOR. <br /> <br />Notwithstanding any of the provisions of the CONTRACT DOCUMENTS, the <br />Executive Director of DISTRICT shall be the only individual authorized in any way <br />to authorize CHANGE ORDERS(s) or to amend or modify the terms of the <br />CONTRACT DOCUMENTS. DISTRICT may designate a DISTRICT <br />REPRESENTATIVE, who shall be the individual with authority to represent the <br />Executive Director in dealings with CONTRACTOR and furnish CONTRACTOR <br />with data, information and records as may be required and necessary pursuant to this <br />CONTRACT. <br /> <br />Any dispute concerning a question of fact arising under the CONTRACT <br />DOCUMENTS which is not disposed of by CONTRACT shall be decided by the <br />Executive Director of DISTRICT., This "Disputes" claim does not preclude <br />consideration of questions of law in connection with the preceding statement. <br />CONTRACTOR and DISTRICT agree that all unresolved disputes that remain after <br />the Executive Director's disposition will be subject to the resolution process defined <br />in DISTRICT Board's Resolution No. 64, Series of 1988, Rules and Regulations for <br />Appealing Staff Decisions Regarding Enforcement of Contracts and Resolutions. <br /> <br />B. Field Orders <br /> <br />The DISTRICT may at any time, by issuing a FIELD ORDER, make changes in the <br />details of the work.
