Once this is complete, we will be able to
determine if the wells were impacted after the project is complete.

II. The City's plan for the land acquisition will start by first obtaining fair market
appraisals for the property to be acquired. The City has directed us to locate the
proposed acquisition line parallel to the crop planting direction and to include
excess property to make sure the City does not leave the land owner with
unfarmable corners or short crop row areas. The City will begin negotiations with
the fair market appraisal and work with the landowners from that point. The last
recourse will be eminent domain. Some landowners have started accepting that
their land will need to be acquired for the project and have been pointing out how
they would like their field access laid out. The current design has already started
including these comments to accommodate their needs. The City has started
meeting with the appraiser to begin putting the initial market values together.

12. The flood control channel and the South Platte River branch channel confluence
and all work associated with this project will be on private property. The
landowner whose field is crossed immediately west of the confluence also owns
this portion of the river and a portion of the island across the river. No Colorado
Department of Wildlife property will be impacted by this project.

If there are any additional questions or comments, please call me at 303-221-0802.

Sincerely,
ICON Engineering, Inc.

~~.

Ron Enserro, PE

CC: Joe Kiolbasa - City of Sterling

Enclosures

...

..v...?,

.

.

.
