<br />concerning the ESP A CREP and technical assistance for implementing <br />the CREP program in general in accordance with applicable statutes, <br />and laws regulating such actions. <br /> <br />I. Permit successors in-interest to existing contracts to participate under <br />the ESP A CREP in the same manner as allowed for under other CRP <br />contract, as provided in FSA CRP National Directives. <br /> <br />J. Share appropriate data, in accordance with procedures, restrictions, <br />and exemptions established under the federal Freedom of Information <br />Act, federal privacy laws and other applicable laws with Idaho to <br />facilitate Idaho review of applications and monitoring efforts. <br /> <br />K. Approve CREP Offers in accordance with FSA CRP National <br />Directives and this Agreement. <br /> <br />L. Develop in cooperation with the participant a conservation plan for the <br />applicable acres enrolled in the ESP A CREP. <br /> <br />VI. STATE COMMITMENTS <br /> <br />Idaho agrees to: <br /> <br />A. Contribute not less than 20 percent of the overall annual program costs <br />through a combination of cash contributions and certain in-l(ind <br />services. Appendix 3, "ESP A CREP Projected Costs" indicates the <br />level of support that various local and state agencies have pledged to <br />the project as cash contributions and in-l(ind services. The in-l(ind <br />services include current water conservation activities, monitoring <br />activities, and wildlife enhancement activities proportioned out to <br />reflect the amount of CREP acreage within each organization's <br />individual jurisdiction. <br /> <br />B. Be responsible for all of the following: <br /> <br />1. Providing a one-time Idaho Incentive Payment (lIP) of $30 per <br />acre to all participants who meet both of the following <br />requirements: (a) have been diverting groundwater from that <br />portion of the ESPA CREP project area identified in Appendix 4 as <br />the "Incentive Area," and (b) enter into an Agreement Not to <br />Divert for the term of the Federal CRP contract. The total of all <br />lIP payments shall not exceed three million dollars ($3,000,000). <br /> <br />11.
