These include a 1992 adjudication for 581 cfs during July through <br />September, and a 300 cfs instream flow right of return flow accretions filed in 1994." <br /> <br />Comment #4, pg. It is a 20 cfs condition on <br />a 404 permit for Jerry Creek Reservoir. The term is included in Ute Water Conservancy <br />District's decree in Case No. W3406. <br /> <br />Comment #5, pg. E-31, paragraph #2 starting with "Ms. Uppendahl.....": <br /> <br />Replace the entire paragraph with "Ms. Uppendahl provided an overview of the <br />Recovery Implementation Program for the Endangered Fishes of the Upper Colorado <br />River Basin (Recovery Program). This program was established by a Cooperative <br />Agreement between the Department of the Interior, the States of Colorado, Wyoming and <br />Utah and Western Area Power Administration. The agreement was signed by all parties <br />in 1988 and outlined a 15 year plan for recovery of the four endangered fishes. There <br />are five key elements of the Recovery Program, one of which is to provide instream flows <br />in various reaches of the Upper Colorado River Basin to benefit the endangered fish. The <br />CWCB plays an active role in the Recovery Program as it is the only entity that can hold <br />an instream flow water right in the State of Colorado, and must protect the State's <br />compact apportioned waters. Specific actions (studies and tasks) are identified in the <br />Recovery Implementation Program Recovery Action Plan (RIPRAP) document, and are <br />updated annually. The Program Director for the Recovery Program is John Hamill of the <br />United States Fish and Wildlife Service. <br /> <br />Comment #6, pg. E-31, paragraph #3 starting with "The CWCB....": <br /> <br />The floodplain along Plateau Creek is an issue with the CWCB. Even though <br />there are no CWCB designated floodplains along the limits of the project, there has been <br />documented flooding along Plateau Creek which must be addressed during the design <br />phase of this project. The floodplain report entitled Floodplain Management Study for <br />Plateau Creek, Grove Creek and Buzzard Creek at Collbran, Mesa County, Colorado, <br />prepared by the U.s.
