<br />. <br /> <br />Nos. 1 & 2; and 3) surface diversions at the Grand Elk Diversions I and 2 for storage in the <br />Grand Elk Meadows Ponds A-F. The Applicant seeks to use Green Mountain Reservoir, Wolford <br />Mountain Reservoir and Grand Elk Ponds A-F as augmentation sources. To the extent that the <br />Applicant seeks to operate the augmentation plan and exchange in accordance with Case Nos. W- <br />1881 and 90CW236, the Applicant will comply with the terms and conditions of those decrees. <br />Pursuant to paragraphs 6 and 7 of the decree in Case No. 98CW31I , to the extent that the <br />Applicant seeks to operate an augmentation plan and new exchange for potable uses, the <br />Applicant agrees not to make out-of-priority diversions unless the CWCB's instream flow water <br />rights decreed in Case Nos. 80CW448, 80CW446, 80CW447, 90CW308, and 90CW294 are <br />satisfied, or the Applicant is able to replace the depletions in time and amount, upstream from the <br />place where the depletions impact the stream. Pursuant to paragraphs 6 and 7 of the decree in <br />Case No. 98CW311, to the extent that the Applicant seeks to operate an augmentation plan and <br />new exchange for non-potable uses, the Applicant agrees not to make out-of-priority diversions <br />unless the CWCB' s instream flow water rights decreed in Case Nos. 80CW 448, 80CW 446, <br />80CW447, 90CW308, and 90CW294 are satisfied, or the Applicant is able to replace the <br />depletions in time and amount, upstream from the place where the depletions impact the stream. <br />. So as to assure the operation of the augmentation plan, junior diversions, and junior exchanges <br />will not cause injury to the instream flow water rights held by the CWCB, Applicant will install <br />and maintain such water measuring devices, implement such accounting procedures, and such <br />calculations as may be required by the State or Division Engineer to administer the terms ofthis <br />decree. The Colorado Water Conservation Board shall have access to any such measuring <br />device(s) at reasonable times in order to make readings therefrom. <br />. The State Engineer shall curtail all out-of-priority diversions, the depletions from which are not so <br />replaced as to prevent injury to vested water rights. <br />. The Court shall retain jurisdiction in this matter for a period of five (5) years following the date <br />on which build out of the Grand elk Ranch & Club Subdivision, including the golf course, <br />reaches 75% of its approved total. <br /> <br />. <br /> <br />Cases Resolved Without Filing Statements of Opposition: As part of the water court resume review <br />process for January, February and March 2006, the Stream and Lake Protection Section staff was able to <br />achieve protection of the Board's in stream flow water rights without filing statements of opposition in <br />five cases. This approach conserves the time and resources of all interested parties and the water court. <br />Staff discussed its concerns with the applicants' attorneys, and obtained letters from those attorneys on <br />behalf of their clients agreeing to include terms and conditions in their decrees that will prevent injury to <br />the Board's ISF water rights. The applicants will provide staff with copies of all proposed rulings <br />submitted to the water court. <br /> <br />Decreed New Appropriations: Stream and Lake Protection Section: -The following instream flow <br />appropriations have been decreed by the Water Courts: <br /> <br />Stream Case No. Appropriation Adjudication Year <br /> Date <br />San Miguel River 4-05CW154 January 25,2005 2005 <br /> <br />Request for Administration of Instream Flow Water Rights <br /> <br />. <br /> <br />Dolores River: On July 17, 2006, staff, on behalf of the Board, placed an administrative call for the <br />Board's in stream flow water right on the Dolores River decreed in Case No. 75W1346 with an <br />appropriation date of May 1, 1975 for 78 cfs from McPhee Dam to the confluence with the San <br />Miguel River. Staff placed the call in response to being informed by the Division of Water Resources <br />that two oil drilling companies with no decreed water rights were pumping from the Dolores River <br /> <br />37 <br />
