After the call was <br />placed, the Water Commissioner informed the two companies that to continue pumping, they need to <br />obtain a contract with the Dolores Water Conservancy District municipal/industrial water. . <br />Currently, three drilling companies have obtained such contracts with the District, preventing reduced <br />flows in this reach of the Dolores River. No decreed water rights were curtailed in response to this <br />call. <br /> <br />Fish Creek: On August 18, 2006, staff, on behalf of the Board, placed an administrative call for the <br />Board's Fish Creek instream flow water rights decreed for the reach ofFish Creek extending from the <br />Mt. Werner Pipeline to the confluence with the Yampa River in the following cases: <br /> <br />Case No. 79CW104A - 2 cfs - Appropriation date: 3/14/1979 <br /> <br />The following are water rights that were acquired by the CWCB and changed to instream flow use: <br /> <br />Case No. 76W959F (Hoyle and Knight) - 2 cfs - Appropriation date: 5/14/1910 <br />Case No. 76W959G (Hoyle and Knight) - I cfs - Appropriation date: 10/0 1/1927 <br />Case No. 76W959H (Hoyle and Knight) - 1 cfs - Appropriation date: 5/01/1942 <br />Case No. 76W591 (park City #2) -- 1 cfs - Appropriation date: 7/4/1963 <br />Case No. 76W959J (Welch and Waters) - 2.1 cfs - Appropriation date: 8/01/1944 <br /> <br />Staff became aware of flows dropping below the decreed ISF amount by virtue of the SMS Alert <br />System, which automatically notifies staff via cell phone and email when gages in the system indicate <br />flows below a threshold amount. After consultation with the Division Engineer for Water Division 6 <br />and the CWCB Director, staff submitted a written request to the Division Engineer for administration <br />of the Fish Creek ISF. The DWR had informed staff that there were some undecreed and junior <br />diversions, mainly into ponds, that could be curtailed as a result of the call. In administering the call, <br />the Water Commissioner consulted with the Mt. Werner Water and Sanitation District. The District <br />volunteered to release approximately 3 cfs from Fish Creek Reservoir to provide replacement water to <br />the above-described pond diversions. Consequently, no diversions have been curtailed in response to <br />this call. <br /> <br />. <br /> <br />Colorado River: On August 24, 2006, staff, on behalf of the Board, placed an administrative call for <br />the Board's Colorado River instream flow water rights decreed in Case No. 80CW447 for 90 cfs from <br />the confluence with the Windy Gap Project diversion to the confluence with Williams Fork River. <br />Staffwas alerted to low flow conditions by Division of Wildlife staff and the SMS Alert System. As <br />a result ofthe call, the Division Engineer and his staff required the Middle Park Water Conservancy <br />District to release 5 cfs from Lake Granby between 8/31/2006 and 9/3/2006. The flows in the reach <br />are currently still below the Board's ISF right and the water commissioner is currently evaluating <br />which water rights are in priority and will continue to work with staff on the status of the call. <br /> <br />Proposed ISF Recommendations for 2007: CWCB Staff has visited all of the the 2007 proposed <br />in stream flow recommendations with the exception of Beaver Creek in Moffat County. During these site <br />visits, staff has collected additional flow measurements, photographs and video of the stream, and has <br />performed further investigations of water rights and diversion activity as necessary. Staff has also met <br />with the Division Engineer and their staff and other interested parties in an attempt to address issues and <br />concerns. On September 27, 2006 staff will visit Beaver Creek and meet with Moffatt County <br />representatives and T. Wright Dickinson. <br /> <br />Brown Bag Presentation to CWCB Staff on ISF Program -- To provide the CWCB Staff an <br />opportunity to learn about the Instream Flow Program, the Stream and Lake Protection Section held a . <br />"Brown Bag" session on August 30th.
