Troy (::arman of Icon Engineering plans to attend the CWCB <br />meeting to answer technical questions and support the request made by the Town of Columbine Valley. <br /> <br />Discussion <br />The project performance schedule is: <br />. Request CWCB easement approval - September, 2006 <br />. Execute Agreement between Columbine Valley & CWCB - November 2006 <br />. Final Construction bid documents - November, 2006 <br />. Estimated project completion - December 2006 <br /> <br />The staff finds that these uses can work in harmony within the CWCB project right-of-way with certain <br />subordination requirements and special construction considerations, which must be stated in the <br />easement agreement. <br /> <br />Conditions for the Easement - If the easement is granted, the owner shall comply with the following <br />conditions: <br /> <br />1) TIME PERIOD - The EASEMENT shall be for a term of25 years and can be renewable. <br /> <br />2) PERMITS - The owner shall be responsible for securing and monitoring all required federal, <br />state, and local permits pertaining to the easement request. <br /> <br />3) INSURANCE COVERAGE - The CWCB shall be named as an additional insured, and shall . <br />have coverage in the amounts established by the Colorado Governmental Immunity Act - part <br />one of article 10 of title 24, lOa c.R.S., as amended. <br /> <br />4) FEE CONSIDERATIONS - A recommendation will be made that is in compliance with the <br />CWCB easement fee guidelines for this request. <br /> <br />5) RECLAMATION OF THE SITE - A reclamation plan and all site grading plan shall be <br />developed and provided to the CWCB for approval prior to the construction and completion of <br />the proj ect. <br /> <br />6) NON-EXCLUSIVE EASEMENT CLAUSE - Language will be stated in the easement that will <br />reserve the CWCB's right to grant additional easements on the same land covered by this <br />easement. <br /> <br />7) EASEMENT APPLICATION - The applicant and/or agent have complied with the provisions <br />of the most current version of the CWCB Easement Guidelines for the Chatfield Downstream <br />Channel Improvement Project. <br /> <br />Easement and Fee Considerations <br />The Town of Combine Valley requests and CWCB staff concurs with the recommendation to use the <br />Method III Special Use Consideration for the following reasons: <br />. This is a public works project that benefits the citizens of the State of Colorado; . <br />. The easement incurs minimal cost to the CWCB; <br /> <br />Flood Protection.
