(d) Time for Filing Referendum petitions. Referendum peti- tions must be filed within thirty (30) days after the adoption by the council of the ordinance sought to be reconsidered. Section 5.4 - procedure After Filing: (a) Certificate of clerk. Amendment. wi thi n ten (10) days after the petition is filed, the City Clerk shall complete a certificate as to its sufficiency, specifying, if it is insuffi- cient, the particulars wherein it is defective and shall promptlt send a copy of the certificate to the petitioners' com- mittee y registered mail. A petition certified insufficient for lack of the required number of valid signatures may be amended once if the peti ti oners' commi ttee fi 1 es a noti ce of i ntenti on to amend it with the Clerk within two (2) days after receiving the copy of hi s certi fi cate and fil es a suppl ementary peti ti on upon additional forms within ten (10) days after receiving the copy of such certificate. such supplementary petition shall com- ply with the requirements of subsections (b) and (c) of section 5.3, and within five (5) days after it is filed the clerk shall complete a certificate as to the sufficiency of the petition as amended and promptly send a copy of such certificate to the pe- ti ti oners' commi ttee by regi stered mai 1 as in the case of an ori gi na 1 peti ti on. If a peti ti on or amended peti ti on is certi- fied sufficient, or if a petition or amended petition is certi- fied insufficient and the fetitioners' committee does not elect to amend or request counci review under subsection (b) of this section within the time required, the clerk shall promptly pre- sent hi s certi fi cate to the ci ty counci 1, and the certi fi cate shall then be a final determination as to the sufficiency of the petition. (b) city council Review. If a petition has been certified insufficient and the petitioners' committee does not file notice of intention to amend it or if an amended petition has been cer- tified insufficient, the committee may, within two (2) days af- ter receiving a copy of such certificate, file a request that it be revi ewed by the council. (c) Court Review: New petition. A fi na 1 determination as to sufficiency of a petition shall be subject to court review.
