<br />(d) Time for Filing Referendum petitions. Referendum peti- <br />tions must be filed within thirty (30) days after the adoption <br />by the council of the ordinance sought to be reconsidered. <br />Section 5.4 - procedure After Filing: <br />(a) Certificate of clerk. Amendment. wi thi n ten (10) days <br />after the petition is filed, the City Clerk shall complete a <br />certificate as to its sufficiency, specifying, if it is insuffi- <br />cient, the particulars wherein it is defective and shall <br />promptlt send a copy of the certificate to the petitioners' com- <br />mittee y registered mail. A petition certified insufficient for <br />lack of the required number of valid signatures may be amended <br />once if the peti ti oners' commi ttee fi 1 es a noti ce of i ntenti on <br />to amend it with the Clerk within two (2) days after receiving <br />the copy of hi s certi fi cate and fil es a suppl ementary peti ti on <br />upon additional forms within ten (10) days after receiving the <br />copy of such certificate. such supplementary petition shall com- <br />ply with the requirements of subsections (b) and (c) of section <br />5.3, and within five (5) days after it is filed the clerk shall <br />complete a certificate as to the sufficiency of the petition as <br />amended and promptly send a copy of such certificate to the pe- <br />ti ti oners' commi ttee by regi stered mai 1 as in the case of an <br />ori gi na 1 peti ti on. If a peti ti on or amended peti ti on is certi- <br />fied sufficient, or if a petition or amended petition is certi- <br />fied insufficient and the fetitioners' committee does not elect <br />to amend or request counci review under subsection (b) of this <br />section within the time required, the clerk shall promptly pre- <br />sent hi s certi fi cate to the ci ty counci 1, and the certi fi cate <br />shall then be a final determination as to the sufficiency of the <br />petition. <br />(b) city council Review. If a petition has been certified <br />insufficient and the petitioners' committee does not file notice <br />of intention to amend it or if an amended petition has been cer- <br />tified insufficient, the committee may, within two (2) days af- <br />ter receiving a copy of such certificate, file a request that it <br />be revi ewed by the council. The Counci 1 sha 11 reVl ew the cer- <br />ti fi cate at its next meeti ng fo 11 owi ng the fi 1 i ng of such re- <br />~uest and approve or di saf-prove it, and the counci 1 's <br />etermination shall then be a lnal determination as to the suf- <br />ficiency of the petition. <br />(c) Court Review: New petition. A fi na 1 determination as <br />to sufficiency of a petition shall be subject to court review. A <br />final determlnation of insufficiency, even if sustained upon <br />cou rt revi ew, sha 11 not prej udi ce the fil i ng of a new peti ti on <br />for the same purpose. <br />Section 5.5 - Referendum petitions: suspension of Effect of Or- <br /> dinance: <br />when a referendum petition is filed with the City Clerk the <br />ordinance sought to be reconsidered shall be suspended from tak- <br />ing effect. such suspension shall terminate when: <br />
