<br />., <br />(b) Referendum. The electors of the city shall have the <br />power to require reconsideration by the City council of any or- <br />dinance and, if the city council fails to repeal an ordinance so <br />reconsidered, to approve or reject it at a City election, in ac- <br />cordance wi th the provi si ons of thi sarti cl e of thi s charter; <br />provided that such power shall not extend to the budget, appro- <br />griation, levy of ad valorem taxes and those taxes required to <br />e voted on by the people pursuant to this charter, calling a <br />special election, or author1zing the issuance of local improve- <br />ment district bonds payable primarily from special assessments, <br />1 ev1i n6 speci a 1 assessments, or ordi nance to meet the contrac- <br />tua 0 ligations of the City. <br />Section 5.2 - Commencement of proceedings: <br /> petitioners' committee: <br /> Affidavit: <br />(a) Any five (5) electors may commence initiative or ref- <br />erendum proceedi ngs by fi 1 i ng wi th the ci ty cl erk an affi davi t <br />stating they will constitute the petitioners'; committee and be <br />responsible for circulating the petition and filin~ it in proper <br />form, stati ng thei r names and addresses and speC1 fyi ng the ad- <br />dress to which all notices to the committee are to be sent, and <br />setting out in full the proposed initiative ordinance or citing <br />the ordinance sought to be reconsidered. <br />(b) promptly after the affidavit of the petitioners' com- <br />mittee is filed, the city clerk shall issue the appropriate pe- <br />tition blanks to the petitioners' committee. <br />Section 5.3 - petitions: <br />(a) Number of signatures. Initiative and Referendum peti- <br />tions must be signed by qualified electors of the city in number <br />to at least ten percent (10%) of the total number of qualified <br />electors voting at the last general municipal election. <br />(b) Form and Content. All fages of a ~eti ti on shall be <br />uniform in size and style and sha 1 be assemb ed as one instru- <br />ment for filing. Each si~nature shall be executed in ink or in- <br />delible pencil and shal be followed by the address of the <br />person signing. petitions shall contain or have attached thereto <br />throughout their circulation the full text of the ordinance pro- <br />posed or sought to be reconsidered. <br />(c) Affidavit of circulator. Each page of a petition shall <br />have attached to it when filed an affidavit executed by the cir- <br />culator thereof stating that he personally circulated the peti- <br />tion, the number of signatures thereon, that all signatures were <br />affixed in his presence, that he believes them to be the genuine <br />si gnatures of the persons whose names they purport to be and <br />that each si gner had an opportuni ty before S1 gm ng to read the <br />full text of the ordi nance proposed or sought to be reconsi d- <br />ered. <br />
