<br />. <br /> <br />. <br /> <br />commercial production of agricultural crops or livestock, including use <br />of water for other purposes incidental thereto, on tracts of land <br />operated in units of more than 5 acres, unless contracts adopted prior <br />to the effective date of theee rulee specifically provide to the <br />contrary, in which case the contract definition shall prevail for the <br />agricultural use of Colorado River water. <br /> <br />(b) "Annual Operating Plan" or "AOP" means the projected annual <br />plan of operation prepared in accordance with the criteria for <br />coordinated long-range operation of Colorado River reservoirs pursuant <br />to section 602 of the Colorado River Basin Project Act of September 30, <br />1968, and adopted by the Secretary for operating the Colorado River <br />System during the 12-month period from October 1 through the following <br />September 30. <br /> <br />(c) "Apportionment" means both the amount of Colorado River water <br />available for beneficial consumptive use within a calendar year in the <br />Lower Colorado River Basin and the division of Colorado River water <br />among the three Lower Basin States. Such apportionment may vary <br />depending upon whether the Secretary, in accordance with the Decree and <br />the criteria for the AOP, has determined the existence of a "normal," <br />"shortage," or "surplus" condition. A "normal" condition means that 7.5 <br />million acre-feet (maf) of Colorado River water is available for <br />consumptive use within the calendar year. A "shortage" condition means <br />that less than 7.5 maf is available for consumptive use within the <br />calendar year and a "surplus" condition means that more than 7.5 maf is <br />available for consumptive use within the calendar year. <br /> <br />(d) "Assignment" means the conveyance of an entitlement to <br />Colorado River water from one entitlement holder to another for the same <br />purposes as, and at the same locations where, the entitlement was used <br /> <br />4 <br />
